I claimed because i wasnt doin nothing wrong , i had a problem with my back because of this.The lorry driver was on his fone and didnt notice us all stopped and ploughed into us.I was lucky as i was at the front.I hope he lost his job as when the coppers turned up he tried to blame someone else!!!! He couldnt give a shit!

It is hard to understand why the 3rd party are proposing to settle your claim at such a low sum, especially considering the fact that 3 years has passed since the accident.

If you are unhappy with the medical assessment you have been subjected to and the findings of the experts report, this should be contested fully with the 3rd party. Your own Solicitor should be more than willing to contest this for you - if you are able to identify mistakes within the report or locate issues that the expert has ignored (such as your ongoing symptoms).

As a claims specialist with over 20 years experience in this sector, it is often the case that claimants are surprised by the settlement values that they are awarded. Understandably, most claimants have no idea what a fair compensation settlement sum would be for their personal injury claim. With this in mind, I find it helpful to make sure people understand how a compensation settlement valuation is reached and what is taken in to account to form the valuation of a personal injury claim. Default How to know if I should accept my offer

Baisicly I was run over in by a car around about 1 year and 3 months which broke my foot I only found out it was broken 6 months in though I am now using a machine called a Exogen bone healing machine if this works and my foot is healed in 3 months I would of lost £15,000 wages how much do you think the pain and suffering would be because I don’t no weather to accept there offer of 30,000 and hope it all goes well or chance waiting and mabey losing money but defiantly knowing it’s healed before I accept a payment incase I need surgery what’s is the minimum you believe I would received if it is all healed in a year and a half with £15,000 loss of wages?

I was in a big bike crash in 02 misdiagnosed knee injuries that wasn't corrected until 2 yrs after I had brain injury and psychological problems ptsd also when I had the operation to correct my injuries it took another 4 yrs to be able to walk properly and finally get back to work you can't predict how long it will take so how can you possibly accept before you've recovered your loss of earnings could be a lot more I'm not saying this for the sake of more money but all the other implications an unknown recovery brings like being on your arse with no way to pay your bills as I was i had private detectives following me everytime i went out of the house filming me i was going to hospitals pysio everyday psychologist weekly they edited off the destination to make it look like I was just going out then sent me the video lol

Thank you and the only consern I have it if I wait it is all ok and I lose money tho if I end up with less than what they offered I would be upset

If your prognosis for recovery from a fractured foot is 18 months, the JC guidelines says

"(g) Modest

Simple metatarsal fractures, ruptured ligaments, puncture wounds and the like. Where there are continuing symptoms, such as a permanent limp, pain or aching, awards between £5,590 (£6,140 accounting for 10% uplift) and £10,960 (£12,050 accounting for 10% uplift) would be appropriate. Straightforward foot injuries such as fractures, lacerations, contusions etc. from which complete or near complete recovery is made would justify awards of £5,590 (£6,140 accounting for 10% uplift) or less. Modest injuries that resolve within a short space of time will attract lower awards. Awards for minor foot injuries resolving within a few months, with little impact on lifestyle or day to day activities, are unlikely to exceed £1,950 (£2,150 accounting for 10% uplift)."

So it sounds like for your injuries they are going top whack of that bracket. Add in the loss of earnings and £30k is about right. I would, however, suggest waiting for the 18 months to pass to make sure you have recovered properly as the next bracket up (f) Moderate

Displaced metatarsal fractures resulting in permanent deformity and continuing symptoms. There may be a risk of long-term osteoarthritis and/or future surgery. £12,050 to £21,910

You can always ask for an interim payment of your loss of earnings whilst you wait to recover in full.

That all depends. If it's just a standard offer, then they can pull it at any time. If it's a Part 36 offer, then you have 21 days to accept or reject. If you reject and later on you are awarded less, then you could be responsible for their costs between the first offer and the settlement.

I assume you have Solicitors acting for you?

yes I do have a soliciter and if it was you personally and you thought it had a good chance of healing in 3 months would you take it or leave it in both situation with the part 36 or the other one?

Thank you. Also if you was gonna take a guess what do you think minimum is that it could drop too? If you don’t want to give your opinion it’s fine sorry I just don’t know a lot want to get as much info off some one that knows something as possible. Either way thanks very much for all your help.
