removing a dvla wheel clamp
well a good friend of mine ahem lets call him billy bigspuds
today put a car of his on the road that was untaxed, he came home to find a lovely big yellow triangle shaped thingy on his wheel and a HUGE sticker saying untaxed vehicle
so billy bigspuds removed the clamp and removed the car and hid it, the bad thing is billy bigspuds told me the car is registered in his name
so he knows hes gonna get some horrid letters from the dvla and more than likely a tap on the door from old bill as it was illegally declamped
billy big spuds does still have the clamp but he cut the chain to bits
anyone been in a similar situation? bills big spuds is gonna send the trade slip off the logbook in morning to say he sold the car a week ago as he did or erm well yes of coure he did didnt he orificer

oh, and someone not paying road tax, which we ALL have to pay, is a cut above is it?
its the same rules for all of us, and i dont see why some people should get away without paying.
the car shouldnt have been on the road, and dvla are doing what they are payed to do, whether you like it or not, they arnt there to make freinds

If they had photographic evidence, which I am sure they did, then they could ask around the area to see if anyone saw you removing said clamp......in which case they can push for criminal damage !
But on the other hand why hide car, surely you came home from work and there was no clamp on it, what are the chances of anyone seeing you and admitting that to dvla..........could they really prove you removed clamp if it is never found.......
Surprised it was clamped and not removed with a streetlifter truck
Just pay the tax and get it dealt with, how would you feel if it was hit by an uninsured driver and left ???

Personally, the sooner they stop taxing us on ownership of a car and put duty on fuel so we are taxed on use of the car, the better. That, obviously, depends on the bastards getting the right level, but all the increases are supposed to be "for the environment" and - as far as I know - having a car quietly rusting in the garage is doing very little environmental damage.

to late, the chains fucked and id put money on your mate billy bigspuds being fucked over as well.
i once played a "sold it to an invisible lodger who moved out without leaving a forwarding address" scam over more serious motoring offences with the police many years ago. i got away with it as they couldnt prove a thing but they harrassed me and my missus for months after hoping to get me on something else.i stuck the car in storage then "bought it back from a guy in the pub" a few months later and re registered it back to me.

regarding roadtax, billy bigspuds owns several vehicles but does also buy / sell, he cant tax them all. yes they were doign there job and quite right too however billy big spuds couldnt be arsed paying 200 quid charge plus 21 quid a day plus having to tax said car

he will more than likely need a good solicitor,he runs the risk of getting done for perverting the course of justice,also criminal damage,or theft of a wheel clamp,tell ure mate wait for the knock at at the door, he would of been better payin up,

not always the case. i bought an untaxed escort van but with a current tax disc in the window from another escort car from a guy on a building site that had been caught already and i drove it every day for months before i noticed the tax disc was false. the dvla didnt get in touch after id become the owner and it only came to light the 1 day i didnt use the van i came home to find it clamped

we have had lots of changes early this year at vosa, i assume they have had the same, and in a month or so things change again, and they have more powers when clamping etc
they will get them some how, the chains are all linked together now
if you try to tax a vehicle that hasnt been taxed or sorn it flags straight away

i know someone who did this when there pug 106 was out of tax.
he cut it off, He had a man in a dvla jacket come round then the old bill,
he filled in the log book etc, and tried what your "mate" is doing...
still had to go to court and got raped.

too late now, but what billy bigpotatoes should have done is let the air out of the tyre jacked it up and lever it off. worked for me and no damage done

they cover pretty much all areas now tbh,
if the vehicle is scrapped the dvla will know, as the vehicle will be issued with a C.O.D marker, when its scraped
if its sold the flags will stay with it, and who is the new owner lol
the car cant be taxed, if you try the dvla will screw you, lol
you cant drive it, if you do you run the risk of being picked up by the police as there anpr cameras will get a ping off it, dvla have lots of cameras about, in place you will never know about! reading reg numbers,
and as far as i know the current owner is liable for anything that happens untill the new owner is on the v5...so matey in this thread is screwed imo,

he cant sell it, as the new owner will soon dob him in when he gets a visit

surely billy bigspuds can get a mate of his with trade insurance to pop into a post office and do it no worries
cant sell it? dont be silly billy ball bags has a car with mot and a logbook etc sure he can sell it, just not from his address.

how does billy bigballs tax it after the offence if the insurance and v5 is in someone elses , maybe your name?
you need to physically show them the disc at their local office then they refund the £120 indemnity. that indemnity doubles if not released within 24 hours iirc but you get that refunded if/when you show them your tax disc within 2 weeks.then they send someone out to release the clamp....and since youve taxed the vehicle after the event the damage comes back to you .

the same thing happened too me about 5 yrs ago,it was the old style clamps with the bars and lock in the middle and all i did was let the air out the tyre and managed to get a socket on all the wheel bolts by moving the car back and forth for room,thot i had done good as i had the car sold but shifted the car and went home too the police at the door saying they had witnesses and threatened too charge me with theft of the clamp,the only way i wasnt charged was because i handed it over UNdamaged,think you might be a bit fucked on this one
