Default seeing as everyone is claiming...

i've told my old dear to call up one of them compo lot to see if she can get anything for tripping over on the pavement

she's pretty banged up, ambulance, cuts to her hands and knees and pain in her shoulder and hip which is why i've had the day off today

other than pictures and names of witnesses and times of treatment etc, are there any other obvious things i'm forgetting?

did i mention she's a pensioner and blind in her right eye so may not have seen the dodgy flooring near the bus stop?

does that make any difference?

and can she claim for my lose of earnings if it gets to that stage?

Get photos of where she tripped,what tripped over,use a ruler or tape measure and take piccies of the pavement any especially if there an obvious height to the said peiece of pavement.

Maybe use a tap measure and meausre if it stick up other then that contact Stu @ Care Claims Centre

as for claiming for something like this.....i class people who consider this the same as something i might step in in the street....

no doubt a claims advisor wil be along shortly to advise on what to tell the doc.....

also lay a local paper with the date on VIEW on the floor next to the flag in the picture then if its fixed afterwards you always have a backup..

Couldn't agree more! My daughter fell in a playground the other day and chipped her front tooth. An old woman saw it happen and came rushing over - I thought she was concerned for my daughter, but no, she came over to tell me I should claim from the council!!!

As a taxpayer, I vote that councils everywhere stop building, repairing or maintaining anything, and spend the money telling us all to take more care. Then, if we trip, stumble, break our car or whatever, it will be our own fault and no need to sue anyone - just like in the old days when everyone had some personal responsibility and a lot less of these marvellous "rights".

I think they've made a start on this, judging by the state of the roads!

if she tripped due to uneven/dodgy or broken kerbstones then get a claim in, thats what insurance is for. if she tripped and it was her own fault/accident then she should get nothing.

there are lorries going in and out of the a house building site next to the bus stop which ripple the tarmac up something chronic

the street has been up in arms about this building development so it's not as if the council don't know about it

if it was me i'd probably put it down to experience, but ask the question: what would you do if it was your old dear? tell her to look out and watch where she was going? what if she was blind in both eyes? should she not go out at all? what if she was a fully sighted pensioner? do the rules change then as well?

if someone is negligent then claim, if you fall over in the playground then don't, fairly simple

she also claimed when she fell off a bus because the rear doors are supposed to jam the handbrake on until they are fully closed but there are ways around it for the drivers to make a quick getaway, should she have just shrugged her shoulders and not worried about both her bleeding knees?

like said, if its someone elses fault or negligence that allowed this to happen then go for it. thats what insurance is for and claiming makes sure they pay more attention to their duty of care in keeping things safe in future.

Pensioner so no loss of earnings to her.
Injuries - Well we have a thing called Ambulances and the NHS so she wouldn't have incurred any costs from that

The whole street is up in arms about it, the council and you know about the condition of the pavement yet you let her out on her own knowing about her dodgy eyesight and the uneven surface. It's you she should sue, for not taking proper care of your old dear!!!

the pictures don't really show how uneven the ground is where the lorries have been in and out of the building site dropping off stuff

there is a bit of tarmac that's been repaired that is higher up than the rest of the surface (where the builders on the site had dug a hole into the ground and hooked up to the electric mains to power their tools ) and there are 2 distinct depressions where the tarmac has been sufficiently squashed to allow lots of puddling of water when it rains

my deaf and blind disabled grandma was on a flight back from skiing in the alps and inadvertently opened the emergency escape hatch at 30,000 feet thinking it was the toilet ,should she claim even though the authorities have yet to find her

im sure most of you saying oo but why should we pay for a old dear thats claming wouldnt be so kean to say that if your old lady fell over would you.. if you are then your a bunch of selfish cunts.

Secondly if you crash your car or your dad or mum crashes there car who you think pays for it?? you do! so what diffrence does it make what the claim is?

For the blind on here, why don't you ask yourself how much you pay in taxes, just in road fuel, road tax etc, then question why we shouldn't have the best roads in the world, and where is all the money going, apart from paying the banks large bonuses year on year for fucking the economy up amongst other things.
I get this shit all the time "oh you're not a taxpayer"(as I don't work) would fucking love to know where I can fill up and spend money that is tax exempt.
I say claim, if it makes the arsehole councils actually give a shit and do what they should be doing with the money your taxes give them then it's for the better.
Last year my council spent over Ł1,000,000 on compo for thier failings just from trips falls and other stuff, yet admit that is because there were Ł640,000 in repairs outstanding.
So they can't find the money for repairs but can for compo, even though repair is cheaper.

if nobody claimed would anything be repaired? i doubt it so who would be better off the counsil of course. every one keeps on about the amount of taxes or insurance costs but get you head out the sand because they would not change, to many money grabbing b@astards so y not be the one claimin the money i bet she paid enough taxes in her life.

yep, anyone thinks that their insurance premiums would go down if there was no exagerated claims lives in dreamworld. theyd still go up and the brokers/companies would get richer.

The simple fact of the matter is, if the paving, kerb was in an acceptable state and manner then this accident would never have taken place. As for 'Don't met let me hear you moan about insurance in the future'? Well then, don't let me hear you claim when you next have an accident because of the state of the roads, etc. No matter how severe. Which I'm sure some of you who have replied, have moaned about pot holes. And, incidentally claimed!

i can belive how most of you are behaving. a old lady who has most likely paid more taxes in her lifetime than you lot have waisted on fuel is getting taken the fun off because she tripped over a badly maintained area which has been complained about on numerous occasions, and all you lot can do is slate the situation what if she had a heart attack because of it would you still be doing the same. its a shambles what you lot are doing just imagine it was your nan or mum, this women is partial disabled aswell.
nothing would be done if no one put claims in for there injurys the roads would be lot worse than they are. for all you dreamers who think insurance premiums will go down if theres less claims are more thicker than you seem it will just mean more profits for the owners.

cheers everyone

at the moment "compensation vultures for you" ahve sent here a big 100+ page bit of paperwork to fill in before they decide if it's going to go ahead and if there is a case for someone to claim against

otherwise it'll just go down to being "an accident"

i shall be reporting it to the council first thing on monday morning though and see what happens, i'm just going to call the same number i did and ak to speak to teh same woman who dealt with my suspension claim

dan, milk tooth of proper tooth?
get it sorted asap though as she'll thank you when she grows up
