As a garage would it be illegal for you to have a head unit out of the car on the workbench (which may have just been repaired ) and being tested ?

Its obviously work related rather than for the purpose of entertaining customers

But, I'd wager that the letters are sent out to businesses as matter of course, not necessarily because you've been 'reported' or anything.....

bitold hat this, they dont really pursue it thou, if they turn up you will have to pay. But chances are they won't. In fact they turned up at my shop and I still never paid, and they never came back
But I do have to pay it for my bar.

this law was out when i was 16 working in a welding factory

what i don't get is why they start clamping down on it now of all times when there screwing every penny out of us anyway

i mean it has been illegal to record off the radio for years but how many people have done that ?

what if they started pulling you over searching for copied cd's in your car or recorded tapes off the radio and giving out fines

bring back the 80's i say at least you could have some sort of life in them days

As long as youve got a TV license for the premises i dont see why not. Knowing the tv license cunts it will breach some "multiple occupancy" or public performance rules or some similar bullshit.

Then your boss is daft - why pay to be allowed public performance rights, and then tell you can't listen to it (or did he get a fine?)

As for each employee having their own radio - doesn't get around it unless they are wearing headphones....

We had a letter like this at the Chippy in St Annes on Tuesday.

I threw it in the bin, and carried on listening to my radio.

I have it low down now and only I can hear it. HONEST!!

If they come on the property without the permission of the owner surely they are trespassing so threaten them with that?

What a joke, the radio should be free as the stations do pay to play the records !!

Playing music publically you have purchased is illegal technically... !


The night club I am involved with pays around Ł1100 per month to PPL (Performing rights).

I bet the only reason this is happening these days is due to the change in how people buy music. More are downloading illegally aswell as legally so therefore the PRS are trying to find more ways to get the income that artists are due. Whether this is petty or not its always been the law.
I'm wondering if you do pay up, will they send the PRS round every month or so to log the songs that are being played like they do in nightclubs?? The fun I used to have with them years ago. They'd stand at the bar trying to write down all the tracks I was playing so I used to go mad and minute mix for about 20 minutes or so and see if the useless twats could keep up!!!

I did this once at the Litten Tree in Northampton when the man came in to log the music.

My take on this is, as some other people have said...It's not a new law, just carry on until someone turns up, write the cheque and tell them to jog along with it up there ass!!

My missus used to work in a hairdressers and they got the same sorta thing, they could have the radio on, but only if was in the back for the staff, if it was loud enough for the customer to hear then it was illegal.

leave it on in the workshop so you can only hear it in there, then if they try to walk into the workshop tell hem that its against health and safety laws for them to be in there without overalls, steel toe-capped boots, goggles and ear muffs!!

We got similar laws over here but I dont know how strict they are towards small companies. Most radio stations are funded by commerciasl and they pay to play the song so why should you have to pay to listen to it as well? They get money from both ends which is kinda like PayPal and we know how much we love them.

Put up a sign that says "Within the premises, all customers have to wear ear plugs"

we have been paying it for over 3 years now stu, it sucks, but, i may just fook them off tbh, as if i only listen to the BBC radio stations then i already pay for that in my TV licence as the BBC is the only reason we pay a TV licence (plus the tax the government gets) what do you think ?

if not what about radio on the internet ???, its not actual radio is it but a PC running,,we have this on one of our systems that runs the call counting as its got speakers for the peep so we have the virgin rock or something playing

It is an interesting law and one that does beggar belief. I worked for Capability Scotland 10 years ago and they were hit with the same for having radios in the buses....for disabled people! I cant remember how it worked but it did have to do with how many people were on the bus/could hear it. Needless to say a quick call and do you know how this will look in the papers soon made it disappear.

Unfortunately, you're wrong Ginge (playing the radio for employees is classed as 'public performance').
