Default Speeding ticket advice

I'm sure you lot have had enough of these so worth asking here

Recently received my 1st NIP (in 13 years!) through for allegedly doing 40mph in a 30mph, the 30mph of which is on the A583 at Blackpool (straight off a 70mph motorway) which itself is a dual carriageway, yet its 30mph?!

Anyway, I requested the image and calibration certificates which I've been sent, however the image doesnt show a speed on it (but Lancashire Police verbally say they DO have one showing 40mph which they will send me, but confused why they didnt in the 1st place?!) and the calibration certificate is annual, not the daily check I thought I would receive (only provided at court apparently).

I've already returned the NIP signed to say its me who was driving the vehicle that day, but not happy that a dual carriageway off a motorway is 30mph in the 1st place and dont believe there is enough signs to warn people of this, and also, the mobile camera that got me was sited right next to a fixed GATSO (which wasnt working) yet I dont recall any signs being displayed that a mobile camera was in use.

I've requested various questions be answered under the Freedom of Information Act regarding the speed restrictions and this, that and the other, but so far not received a response and its now passed the 20 days that they should respond in.

Any advice as I'm not happy to just send £60 and receive 3-points, I normally like to fight things but equally dont want to end up much worse off if still likely to lose in court!

You were speeding. Just take it and be done with it.

What point do you have to argue? That you don't like the speed limit?

I know the road you mean, and its a 30 because there's house's nearby

As RichPon says, just take the points, you'll end up with them if you fight them imo

As been said before, take the points pay the fine. Less hassle, and you just know if u argue your point they will be after you for any little thing for a long time coming.

As said take the points and fine. Theres no point arguing when you've been zapped by a GATSO or mobile camera the courts look at it as they dont lie like people do If it was an estimated speed by a copper sat in a car or on bike then id say argue away and you probley would get away with it but as said speed cameras dont lie thatS the way the court will see it and you'll probley end up with a bigger fine if you go to court over it

"if you thought it was a 70 mph nsl road why were you doing 40mph?"

and you won't be bale to answer that and you'll be even more fucked than you will be at the moment

What point do you have to argue?
For one why a dual carriageway straight off the motorway is 30mph and inadequately signed, and two why down the same 0.7 mile stretch of road (turning into a single lane) is there 4 GATSO's as well as mobile response units cross referenced against the need for such camera's from an accident study etc, when all revenue generated from this force's fine's just happens to be reinvested in the force itself. You often read its the people who contest the offence that sometimes not only get off but then have several other people's fine's reimbursed and point's removed because of an illegal act from the police - not previously found out because people dont contest it.

if they have the evidence but don't show you how are you supposed to know what to contest?

put it in writing that there is no evidence and that one single sloitary picture with no speed showing does not consitute reasonable grounds for this alleged prosecution and see what they say

I think many people misunderstand what a duel carriageway actually is, and how it is defined.

Many posted limits make you wonder, but if you speed and get caught, you knew the risk.
First in many years, got to be caught every now and then.

I didnt think it was a 70mph road, I thought it was a 40mph road, hence the reason I was doing 40mph as most of the dual carriage-way's I've ever driven on are between 40-70mph, dont ever recall a 30mph one!

Already have. I've asked to see the video but they have said no way, only in court, and they have said that they -will- send me an image with the speed on, but they wouldnt normally do this, my reply back was obviously why not, as if they are going to go to the expense of sending out an image in the first place saying you have been clocked at speed X, why not send out the image with speed X showing also, unless there is an hidden agenda in hoping that people will then go to court, still lose, but pay more in costs, keeping the police revenue fund even more topped up maybe...

Plenty around and about town centres, they're all 30, shitloads of them about.
I suspect you don't understand what a duel carriageway is.

I didnt? is that the case? It would be easy to state that any road is 30 unless otherwise stated which -is- actually the case, but dual carriageways tend to always be 40+ in my experience.

At a rough guess I would place it as 2x a single carriageway? normally in areas where there are less/no immediate houses and hence the reason they can put 2 lanes in and go faster than a 30 road the dual carriageway running through my town is 40, the one running at the side of the town is 70, and the only one I've come across that I know is 30 is the one I got caught on. Maybe in Poole things are different.

Yes, street lighting assume 30 unless signed otherwise, but as most have no idea whats what at all, simpler to assume 30 IMO, and most roads where you may not be 100% of posted limit I find do have street lighting.
If there's street lighting and no visible repeaters or gateways, 30.

Hi mate,

Yeah we had a new estate built near us recently where many people were caught speeding in a 30. Everyone bit the bullet and just took it until one person complained, saying that although there were no indicated signs and therefore the road should be assumed a 30, the street lighting was actually too far apart for a 30, the court upheld this and all the previous "guilty, offending, speeders" had their points removed and refunds applied. A great lesson in "just take it, your guilty" etc when something's niggling inside you telling you that your not.

They don't have to give you a copy of the evidence until it due to go to court.
That can't happen until they know you will not be paying the fixed penalty.

The easiest way to get out of it is to let it go to court and hope they can't find or don't bring the evidence, happens quite a bit apparently. If they do present it the penalty is higher if they succeed.
The Police don't get the income from cameras to spend on what they like, it's only used for more cameras and other road safety issues.
There only has to be 2 Speed limit signs, to show actual change of limit, either side of the road at the start of the limit.
All the other signs you see giving advance notice of speed change are to encourage people to slow down, not legally required.
I'd guess the End of Motorway sign is a legal requirement though and could be a warning of speed change.

similar thing happened to my m8 he contested a 40 in a 30 zone he went to court
and the bastard slap a £150 fine and 4 points on him its a chance you take when you go to court

This is incorrect - the speed limit for a car on a dual carriageway is 70mph unless otherwise indicated by speed signs or a system of street lighting. Rule 103 of the Highway Code.

However, in England and Wales you have a quaint rule that says the 30mph limit applies to all traffic on all roads in built-up areas with street lighting unless signs indicate otherwise.

And a dual carriageway is a road with two or more running lanes in each direction separated by a central reservation. Without the reservation the road is a single carriageway even if there are two lanes in each direction.

Take it to court......

If you are found guilty you'll end up with 4-6 points and around a £200 fine...and lets be honest you've got a 99% chance of being found guilty in this country.
