I agree with Silky16v.
The prosecution have to prove their case beyond a reasonable doubt.
There is absolutely no evidence that I can see. Video recording, speed gun readings - NOTHING.
Engine revving??? That sounds like your backbox exhaling gasses from it.
Big deal he referred you. He can refer you to the CSA if he likes! Means nothing.
Get his badge number, go to your police station and make a complaint of harassment against him. GIVE HIM GRIEF!! Use the report as your evidence in court.
Do not let these bastards win. Too many people are accepting points and fines, because they fear of the reprocussions of pleading not guilty.
I've been to court more times for driving offences for giving lip to a copper. Everytime I plead not guilty and get away with it.
If you plead guilty and something happens again in the future you will plead guilty as it's easier.
Don't let them win.

Isn't it at the end of the day their word against yours? Fair enough there's 3 of them and they're coppers but that still doesn't really mean anything. Their opinion and they have nothing to show for it

what did you put in your written statement when you were in the police car? if you confessed to DWDCAA then your fooked at trying to plead not guilty, although looking at the letter you got thats the way i would plea assuming you didn't incriminate yourself sat in the back of the police car..

i had CD10 when i was 20 - 3 points and £100 fine, the main problem is the effect this has in your insurance! mine was effected alot at the time - not good

the trouble with CD10 is you can get one for something as simple as not indicating or more serious like causing a multi car pile up! trouble is insurance companies only seem to take the view it means the worst end!

In reference to what proof - a couple experienced coppers can do you for speeding just by backing each others word on it.
That's their proof I'm afraid.
Fwd and turbo does make wheelspin easy, especially if there's diesel on the road - but this needed to be mentioned at the time, will just look like a get out if brought up at a later date.

Couple weeks back took the box off a lorry, hit bow of a tree avoiding a car coming at us in middle of road going way too fast - copper wasn't interested in the slightest as no one was hurt, nevermind £25k bill.
Yet wheelspinning is the end of the world....
Consistency would be nice.

Bit of a shame really as you've done nothing particularly wrong, I do it all the time FFS, just nip out in traffic!

Can't believe they drag people into court for silly things like this yet only last night some fat middle-aged cunt in a fucking peugeot 406 estate car was overtaking AND undertaking on roundabouts and in thick traffic in rush hour on the way home! I hope the prick had a fucking good excuse!
CD10 is Careless Driving mate - i know mate as I just got rid of it off my licence

They have given me the option to pay it up £10 a week, so thats what they are getting. Wankers.

Workmate was knocked off his motorbike - woman jumped a red light, was speeding, had nearly knocked a cyclist off moments before, and accident was witnessed by a copper.
He won't work again, in pain all the time, hasn't a pot to piss in; can't change a wheel on his car or anything.

This woman got done for due care and attention, 6 points and £100 fine.

How the fuck that works I don't know, she deserves locking up.

I'd torch her house and car if I was him.

Bet an 18 year old lad would have been fucked over for that.

just read through this thread and i am truly shocked at the way you have been treated and the outcome.

If you were in a 1.0 polo or something they wouldnt have batted a eyelid imo and its purly because your in a hot hatch

personaly i would have gone to court and thrown everything at them possible..

and if you got a worse fine because of it or even a ban i would have just bought a motorbike and drove it illegaly, fuck em if they treat you like a criminal act like one imo!

there wankers!!

In the local paper that i got a read at today,

A fella drove up a one way street the wrong way, crossed over a line of traffic and had a head on with another car.

He was fined £300 and got 6 points.

How the fuck it works out that i have been dealt with more severly i do not know?

I understand i done wrong, but the justice system in this country is fucked, the police force are a useless, un respected bunch wankers and young drivers are unfairly treated. Fuckers.

I spoke to a lawyer, because i had signed an ASBO Warning in the car, i had already admitted to an offence.

If i had refused to sign anything on the night, i may have had a case however because i just appologised, done as i was told etc, i effectively plead guilty.

Not really, 2 coppers seeing you speeding will secure a conviction - their experience to judge speed is proof enough.
Easy to say you'd do this and that when it's not happening to you, bit different when you're the one in the shit.

What the..!

That's ridiculous! Shit mate. Wrong place, wrong time. I bet their eyes lit up when they saw an RST acting a bit cheeky. Like Carlo said earlier, if you're in Ayr with a sporty car they're all over you

You should have got them to give you a chase, prob ended up with much the same fine lol

im no expert on traffic matters but I thought driving without due care and attention was when you caused another vehicle to brake or alter its course of direction... wheelspinning, I would say was using a vehicle in order to cause an annoyance.

Like I say im no expert as it was a long time ago since I did traffic but im sure some of the rats that use this site will be able to advise better.

Ill go and get my blackstones to have a look at the offence for you

Right blackstones say: When a constable in uniform has reasonable grounds for believing that a mechanically propelled vehicle is being used on any occasion in such a mannerwhich contravenes ss 3 or 34 and is causing or likely to cause alarm or distress or annoyance to members of the public.

Due care and attention is the standard of driving which is expected of all drivers , even learner drivers . Once you have proved that a defendent departed from that standard of driving , and that his / hers actions were voluntary then the offence is complete.

so from reading that then wheelspinning could be classed as causing annoyance.

****just seen the verdict mate, I think its a bit harsh****

YEAH cos we'd all plead guilty to it when it was as a result of the turbo spooling up wouldn't we

Would i fuck plead guilty if i didn't do it on purpose........

Same here, and by the traffics too!
(although a few months earlier I got well shafted by them for something far more trivial.... swings and roundabouts I guess )

My apologies, I didn't realise a turbo meant you couldn't control your car.

I suppose the turbo should have been taken to court, as it was that at fault - the driver had no control over it whatsoever!

It is very harsh, of course you'd want to plea not guilty.
But that doesn't change the fact you'd be pissing in the wind.

I often walk up to 2 or 3 coppers, and call them cunts.
No proof of me doing it, is great fun!

wouldnt suprise me if the cops went and tipped diesel onto the road just to get people for it, much easier than chasing real crims like twocers (which they never give a shit about do they)

very harsh mate

i've been on the reciving end of cuinty coppers who just want to make you look small

since that incident way back in 1999 i've never signed anything when i've been stopped

they give it the big "we'll arrest you until we find out who you are" but you've already told them and they can check the car on the computer and it's all loads of paperwork really

but i suppose it depends on where you are stopped don't it

if you sent that letter in then they won't have given it a second thought once you plead guilty
