I seem to have bought a car with 11months m.o.t of someone who is a mechanic and turns out it should never have passed,now I know its been a month since the mot,and the seller is saying he didnt mot it,but theres so much more to the story and its getting to the point where I feel like taking it to ministry of transport or something
so what would you do?

This is what my mate found who is an m.o.t tester
1,o/s steering rack boot split
2,o/s cv boot split
3,n/s seat belt detonator gone off
4,o/s rear tyre rubbing on body
5,front tyre rubs on gearbox on full lock
6,the amount of play in o/s front wheel
7,rear o/s tyre rubbing on arch
8,o/s rear spring keeps falling out
Some of them should have atleast been advisorys
Seller also said he does m.o.t's

go to your nearest MOT centre and get them to print you a notice of appeal form out fill it in and send it to the address. Then a VOSA inspecter will inspect the car for a fee of £52 (full MOT price) and will then advise you on the best course of action to take. He will tel you exactly what is wrong with it.

Its not what car it is mate,its the way it was put through an m.o.t a month ago buy mechanics then sold to a mechanic then sold to me with what I can only call a rushed viewing.When someone seems sound and has had a couple of what looked like well looked after cars sells you a non roadworth one kinda pisses you off
I know I broke a few rules,
1,dont buy cars in the dark
2,dont meet in services half way
He said he would be bringing it on a car transporter(so I thought mabye he couldnt get anyone to follow him and take him back),then turns up 2 hours late when the journey on my tom tom from where we met said 2hrs to where he was.did a quick test drive round services car park all seemed fine,filled up with fuel and as soon as I hit the motorway the steering was all over the fuckin shop!!couldnt keep the car in a straight line so had a 2 and a half hour fight with the wheel.called him as soon as I noticed but all I got was "na mate steerins fine".had it checked the day after wheels were toeing out and 2 bolts that go from shock to hub were rounded of and loose
tried to tighten them up and just worked loose again,thats when my mate started looking a bit more at it.

Bought a car like that once. White mk5 Escort. Was so chuffed with the chavvy bodykit and WRC spoiler
but it had 11 months MOT, and I drove it all the way back from Stoke at night, first time on the motorway. Turned out the steering rack was fucked!

As a current MOT tester !
I am sure the seller is conversant with VOSA and their procedure with "dodgy" MOT's
Upto 28 days after a certificate is issued and they will investigate complaints vigorously
After this time they "may" have a look
If the chassis is rotten or brake pipes are severly corroded then they will be interested
Let me have a guess what the MOT station will say in their defence on what items have been found

Im a tester as well and have to agree with everything mentioned above, if it had been corrosion or rusty pipes they would have been all over it as they are the easiest things to prove when it comes to saying that there was no way it could have been that bad at the time of inspection, especially if it was only a matter of weeks since inspection.
A steering rack boot an cv gaitor could have split within hours of the test being done, seat belt pre tensioner being triggered is only an advisory and does not warrant a failure, tyre rubbing on the body could mean a coil spring has broken, again this could have happened driving over a pothole right outside the testing station, and the play in a wheel again does not warrant a definate failure as could have been ok at the time of test.
I would say you are almost definately throwing 52 quid down the drain by appealing mate but you never know it might be worth a shot.

I agree with RS2000CUSTOM, but the MOT inspectorate, NOT VOSA will be very interested in any corrosion related problems, up to THREE months.
My friend is senior inspector for eastern region, and he inspeted then took away the MOT status of the man who did the mot on my car I bought from him due to corrosion problems.
You are most likely wasting your breath talking the the seller.
Also any retest if done under the above circumstances is FREE if they agree it should not have passed.
The real irony is even if the car is not MOT worthy you can still use the dodgy MOT to drive it on, so long as not unroadworthy which is completely different.
This happened to a car I had, and the MOT INSPECTORATE told me I am quite legally allowed to drive on it as it was rusty but did not consitute a DANGEROUS car, just not up to MOT std.

The car had a full mot when i bought it, drove it for a month then sold it on to mr worth. I trailored it down in my dads very nice saab 9-5 then i gave him the keys and said go for a test drive....so he did. Came back and said yep seems fine to me. At that point he handed money over as he was pleased with the car
I am an mot tester and no i didnt test the car, the items he lists above are not failures, and they prob did get advised. You trying to tell me a split INNER cv boot, a ripped rack gaiter and the other little items he mentioned are DANGEROUS?? i dont think so. Problem with this guy he looks for faults, i drove the car for weeks enjoying every minute knowing full well it was no rolls royce, it is infact a very low corsa with a very big engine so lets face it, its gonna pull you about a bit!!
By all means go to VOSA i dont give a fuck
fuck me all i have done is sell a good little second hand motor to someone that has decided he is an inspector and a stone chip means its dangerous!!

i can see business is going to be booming in your neck of the woods, after all, if you can get an mot AND sell a car to soemone on teh basis that you felt it was fine and he drove it round a car park and didn't spot that it wouldn't go straight down the motorway at motorway speeds you'll be presenting top gear and writing motoring columns in the sun in a weeks time

sorry but i kinda agree with the above, wheels can be changed for mot, cv boots etc can split after a mot, for the price of a couple cv boots fitted etc id just fork out and have it done, not exactly dear is it.
makes me laugh it really does, as above if it was rot or corroded pipes, hanging wishbones or rear bush's etc i could totally understand
ok the springs a bit iffy but if it was in place at the time of the mot they cant fail it
fix the car and atleast you have confidence in it, maybe get the chap you bought it from to offer you a tokken gesture of £50 or something, atlkeast it will pay for the parts

A split CV boot is no longer a RFR (reason for refusal) and should a vehicle be presented for test with a split CV boot then "grease leaking onto hub components" is the RFR selected and this will issue a fail

the original question doens't seem to have been answered though, what is the op going to do about the car with, what he feels, is a hooky mot?
if he can't do jack about it and has to get another one just to point ou the faults with the car which he can then go ahead and rectifiy, will that be the basics of the story and the guy who sold him to him is "laughing"?
or
seeing as the original seller is now giving his side of the story in that "he's piad for it it so i'm wiping my hands of it" should he not have at least pointed out some potential problems?
or

person of their choice BEFORE spending any money
Why do people have mates/mechanics/garages etc check

you my friend have no idea what your talking about so mind your own business, the kid i bought it off gave it a 13 month ticket, he sold it to me with 12 months. i only sold it because i need cash otherwise it would be in my drive now.

I had this when I was a kid. Bought a Mk1 golf GTI on impulse as you do, had 12 months MoT on etc. Went into the garage for a misfire and garage couldn't believe it was actually on the road. At that point had VOSA inspection or whatever they are called, which revealed 22 minor faults and 2 major ones.
Never found out the outcome of what happened to the garage, but was still stuck with apiece of sh1t car that needed a fortune spending...

my 2ps worth
me and danny went to see a car that he won on ebay...a get him to work runabout, 2 hours later this nice shiny thing pulls up
then after half hour of looking round it he found
11 1/2 months mot
2 tyres with wirey shit showing, back anti roll bar had come away from body due to corrosion, the car wouldnt start, it wqs over fuelling like fook,
eterior trim was totally different colour to the car, interior was totally fooked, exhaust was fooked and hanging off and 3 pages of advisories
one of which was
no centre caps on alloys...
wtf.....
theres loads more than i cant remember
amazing what goes through an mot nowadays....
