Default had an accident was i at fault

last night at 6 15pm i was doing 30 mph this is the limit for the road i was driving on, i was just getting to some traffic lights when thay went on amber there was plenty of time for me to stop without doing any danger to the car behind,,,

when i stopped there was a loud bang the prat behind me drove in to me so hard i was lifted of my driver seat my neck was hurting and back but i still got out to the other driver and asked him to pull around the corner so he did....

he said to me why didnt you carry on driving i thought you would of done, i stated that if i did why the hell didnt he start to slow down as the traffic lights would of been on red by the time he got to it,

spoke to police thay said the same thing that the other driver inteded on driving through a red light and explain this to your insurance company..

my car is a wright off but you cant tell as the damage is behind the bumper

he hit the towbar so hard its done this

split the rear panel
bent the towbar
damage the bumper
full tank has got damage and the bracket that holds it up
it also snapped the bottom drop link joint on the front from the force of
inpact

somebody hits you from behind, 99.9% its there fault as they were obo following too close or not paying attention.

its not a ford

its my taxi car astra estate i started up my own service 5 months ago but i was looking at buying a new car next month anyway but still its advice needed

it also put me of the road for 3 hours last night and i lost money can i claim for this

Ultimately your insurers will apportion the percentage of whos to blame. Based on the strength of the evidence on both yours & the third partys claim form.

andy this is what im worried about there was 3 in his car but only me on my own ...

it was one of these big peaple carriers that hit me..

even when a driver in front does something REALLY stupid (not sensible like you did, i mean like i dunno, starting then suddenly stopping for no reason etc) the rear guy is always to blame as he didnt leave enough room, or wasnt paying attention.

I would say not your fault... but I don’t trust insurance companies who knows what they will do.

Its his fault (unless he says you reversed into him!) but as said insurance companies are bastards and will probably try and get out of it.

They arent classed as independant witnesses though, just passengers.

Bit of a shitty situation really, you know your in the right, but the insurers will just gather all the info from both claim forms and sort it out over time.

Most likely outcome is that you'll have your excess(if you have one) taken from the value of the vehicle(assuming they see it as a write off) your end of the claim settled. Then blame then sorted out between both partys insurers over the coming months.

Hope things more quickly for you

i will have to do this tonight mate car is in use at the moment, you should come down here one night on the piss 2 pints and most of them think thay can fight the town



im saving for a new toy a 3 door cossie now i will claim for injury then if thay pay out that will go towords the cossie aswell

next question. As you only started up 5 months ago, have you got the correct insurance etc not sure if normal business use is OK or if it has to be something more special

Id go on amber but he hit you from behind, given what you said its his fault(legally). He should be in a position to stop whatever the car in front does.

nothing diffrent from any other insurance mate

my insurance for my business and for myself to use at any time ive also got it coverd to tow a car transporter with, it states on my insurance

p.t i never found out what happend to that 3 door myself all i know it was sitting in there yard for 2 years

It's his fault entirely 100%.
Due to the location of the crash, it will be obvious who is to blame and what happened, insurers don't waste time these days trying to wriggle out of certanties like this as ther eis too much no win no fee solicitors about, and legal expenses can easily outweigh the claim cost .
On my last case I took the Goverment(MIB) to county court and won, all three claims, the expenses were over £10k on just legal.
The hardest thing is often trying to prove the person was even there, but if you hae all his details don't worry, I assume within 24 hours this was reported as an injury accident, the other persons passengers can also sue him for any injuries.
They will most likely counter sue anyway, nothing to worry about a common ploy.
Keep a record of ANY expenses or effects on your normal life, even down to phone calls, loss of earnings, not being able to do something because it hurts etc etc etc.
Get to the hospital if not already to establish any injury.
The get onto the AA/RAC to get a no win no fee solicitor appointed, if they don't do no win no fee, and want you to sign a sureity don't go near them they are cowboys.
If this is the case just watch TV till the next ad comes up.

His fault. If somebody hits you from behind it's their fault.

Mate of mine got caught with this as he's blind in one eye so to check his blind spot he needs to rotate in his seat almost. He did this on a slip road when the guy in front decided to stop on the slip road and my mate hit him. That went against my mate

got hit from behind, going to court pretty soon, he hit me as i was approching a set of traffic lights

no win no fee solicitersarranged by the insurance company
