at work, they've received a an email from head office saying a wagon was over the limit (dont know the details yet)....anyway my pal and i were in that wagon on that day and time............but we both drive and we cant remember who was at the wheel (honest) so we've asked for a photo.....apparently the police havn't got one!!!!!!!......so none of us are going to say "yes it was me" cos we didn't have a clue we had been flashed..........the boss is saying one of us has to take them.....(tosser)...we've said fuck off......what we suppose to do....??????

They have to send the NIP back with the drivers name and address.

You will then get it in the post yourself......Deny everything and ask for
a picture. Then send it back with your mates address and get him to do the same.

all your boss has to do is tell them who was driving, so he basically has to give them a list with both your names on. It then up to them to contact you. you both say you not sure who was driving at the time, its up to the police to prove who was. this happened on our company and they dropped the points and fine then no one would admit to it.

Pete, your boss has probably said that as if the company don't keep a record of who was driving, and find themselves in the situation you're now in (don't know who was driving), the company (or Director of said company) has to bend over and take the pain.

That's as I remember it as per company cars. I'm pretty sure it was for this reason the company I used to work for wouldn't let pool car drivers share driving for long journeys (i.e. whoever booked the car had to drive).

Not sure how that relates to plant, but can't see it being much different.

we have daily return sheets to fill in with job,location,vehicle etc......my pal does 90% of the driving....but if u havn't seen the camera/van its hard to remember who was in the seat at the time

so they have to give you a picture

the hamiltons got away with a speeding ticket because they didn't know who was driving their car once

so there is a precident set there for getting off

...and if it's a private car, the registered keeper usually gets done, as it's their responsibility to know who's driving. Unless you can afford that expensive lawyer/barrister who gets most of his celebrity clients off driving offences.

My company got fined a grand in similar circumstances (long story, can't be arsed to go into it). It'll go to the local magistrates court and they will decide the fine but no points will be issued- best advice is to deny all knowledge, but your boss might get the hump!
