I'm staggered that Macker can still be having a go at Jay, calling him out of order.

Technically you have obtained that money by deception. Thats an offence under the Theft Act. Sounds like you have one court case, you want to thank your lucky starts you don't have two. The evidence is overwhelming.

People never cease to amaze me these days

 

1) The car should have been sold with a "Sold as seen with no comebacks or warrenty" reciept

2) Off here or not, if someone who bought a car from me demanded money from me to finance any work to it the answer would have been jog on.... (provided the above point had been implemented and also that I knew nothing of the alleged problem)

3) If the buyer had said he was gonna rebuild it anyway, the phone converstation would have ended with "what you fucking worried about, you were gonna rebuild anyway, fuck off and leave me alone you cunt"

Now, maybe it is not on that he took you for Ł500 and then did nothing with the money and sold the car, but I wouldn't have given him the Ł500 in the first place.... So not a lot you can do really......

thats a fair comment.
but in normal circumstances i would have told him where to go.unfortunately at the time i was mithered to death moving house and had him threatening solicitors etc so i did what i did.the least i would have expected would have been for him to have done what he said he was going to do with the money.
its the fact that he didnt that got my back up,which seems to be understandable by all accounts.

there is always going to be fors and againsts in this type of situation which i can understand.

 

Thats also fair enough Jay, and from a ehtics point of view I agree with you. The ethical thing to do would have been for the buyer to use the money you gave him for the purspous you gave it to him for.....

But, there wasn'a contract stating he had to use it for that purpous, so he didn't ACTUALLY have to use it to rebuild the engine - once you gave it to him, it became his money, so technically he can/could do with it whatever he wanted....

Dont get me wrong, I am not advocating this muppet - firstly I would never had had the cheek to ring you up and complain cos I bought a car in the condition I saw it in and secondly, I wouldn't have given any money away to a buyer, but you did what you did, no changing that... Lets see if this guy actually DOES pay you back, cos yes, he WAS out of order, on several levels if you ask me......
