If i were you i would get a friend to say he/she was traveling the other way and saw the accident and she can confirm that you had indicated and slowed down and then the bike hit you as he over took you whil you were turning.

I was witness to a biker being knocked off recently and it happened the same way as your describing except there was heavy traffic and the cars were traveling at about 10 mph and the bike was passing the cars on the outside of the lane (so not across the white line) when a car suddenly pulled out to the wrong side of the road without indicating or even looking to over take all the traffic.

In that respect the biker wasnt in the wrong IMO and I made that statement to his insurance company with what i saw happen and because the driver that knocked him off was claiming he was indicating to turn right (he wasnt, he was just jumping the que)

Thats the first time, something like this has happened to me,
i looked in the mirror before i slowed down,

i slowed to 10 mph, and was on the inner edge of my lane, so wot else would i of been doing?

I wouldn't put the full blame on either person, it was a stupid thing to do, overtaking a car thats slowing down regardless of it they are indicating or not. Its obvious the cars going to turn somewhere. But if you had checked you probably would have seen him and not turned.

If it was me I'd ask the biker how much it was going to cost to repair the bike. Having a claim and loosing 2 years ncb would cost me alot more over the next couple of years that paying for the damage out of my own pocket.

Or if you can I'd try and talk to the biker and get him to agree to pay for his own damage and you pay for yours, claiming off the insurance aint going to help him if they do go 50/50 or side with you.

He wasn't just hit from behind, he turned across the path of the overtaking bike & the bike hit the side of the car. It would be different if the bike went straight into the back of him.

sorry officer i wasn't paying attention to the car slowing down in front of me ...

so ... who's fault really then ... be honest ... if the bloke has already stated that how can he say its the car infronts fault ..

i see loads of bikes as i spend most of my working life on the road.... most are good at reading the road and other cars as they have to be due to the vast amount of car drivers that tend to think they are invisible on the roads.....
but some are totally blind to cars and tend to think they have a right to overtake where ever they want ...

If he wasn't paying attention to the car slowing down he would have crashed straight into the back of of the car.

I dont put 100% blame on either person, both did something wrong.
That would be the biker in this case.

After months and months of crap.

insurance have settled it how they wanted to.

50-50 settlement,

my cars a class C write off, and they said its valve is Ł1000, take away the salvage value of Ł150 (so i keep it) = Ł850
- 50% = Ł425 pay out.

I'm not happy,

as its gonna cost me Ł700 to get repaired by a mate. and i've losted 3 years No claims, which on my Xr2tt cost me Ł140 more this year,
dont want to know how much it will be on the cossie.

But they said i can supplie more receipts to prove it cant be replaced for Ł1000, so might get more.


And whats a class C write off mean?

I think they mean Cat C not Class C... Can be repaired but not economical to do so basically.

Urgh does my head in. I swear i lot of accidents happen by Motorbikes they swerve in an out of traffic, undertake and overtake in innaproprate areas etc. And then they blam the car drive for getting knocked of The same rules apply to them! Does my head in. lol

im fuckin sick of ignorant bikers.

picture me driving along doing my own business, i check mirrors, pull out overtake, here this noise, biker comes over the brow of the hill BEHIND me, and overtakes the car im overtaking going THROUGH THE MIDDLE of me and the other car, and carries on.

get to the ferry and he kicks off my wing mirrors telling me i should have braked to let him continue.

My old man's a biker, so's some of my mates and people i work with.


and every single bike rider i spoke to, Said they would never over took a car at a juntion, or even if it looked like it was gonna do something.
And that it sounds clearly that it was his fault.
