Phone them tomorrow and give them an ear bashing and point out the car is legaly parked is taxed, MOT'd and insured. Explain to them that if the car dissappears you hold the wholley responsible and will take the appropriate legal actions

i thought the car should be tax , tested and insured to remain on a roadside, though I cant be too sure. get on the blower to them anyway, wont do any harm

Last year I tried to report an untaxed car abandoned outside my house, by a neighbour, he had done the same thing 2 years ago with his last car and I got that removed by the council.

This time however I got a phone call from the council to say they could not touch it as it was registered to an address on the same road, and is not considered abandoned, even though it wasn't taxed. He wouldn't tell me where until I told him I knew who's it was.

In an attempt to help me he said he would drop a note through the registered keepers address asking if he wanted it removed, I saw him do that.

5 days later a recovery truck arrived, the neighbour came out with the V5 and the car was removed.

Does the front garden look like a breakers yard ? Is there oil in the road ? Does it look a state ? Does it ever move (well it can't at the moment but you know what I mean), is parking tight and it takes up a space someone who uses their car could park in ? Things like this really do piss people off when it's outside their house or they look at it every day when they come out their front door mate.......................

I have done some Abandoned/untaxed removals for Sandwell Council (West Midlands) as I have a tilt/slide recovery truck.

In no way could I touch a vehicle if I went for it and it had current MOT with the correct registration details on it

If I found the reported car and it appeared taxed I then had to phone the council to advise them

Sandwell Council DO attempt to contact the last registered keeper by post, if no reply or not moved they put a 7 day notice on the windscreen.

The a recovery agent gets the fax to remove and secure store the vehicle for a further 7 days

When that period is over the car can be :-

A - Sold for scrap
B - Broken for salvage
C - Sold as a repairable
D - Recovery agent can apply for a logbook and put car back on road
E - Charge the vehicles insurance company a Ł105 recovery + Ł12.50 per day storage if vehicle was stolen and the insurance claim ownership of the vehicle (within the 7 days)

Option E is why the recovery agent has to store vehicle for 7 days while the old bill check if the car is reported stolen

Basicly after 7 days in storage the vehicle becomes the recovery agents property !

My advise is call urgently any numbers on the sticker cause if you ignore then vehicle will vanish - take names and references for calls.

I was surprised how quick neighbours would move their cars to allow the recovery truck closer to snatch the car away - its as though they are glad the vehicles were going !

Dont beleive any bo*****s about "they cant touch it, its my car" etc etc etc

Councils seem to have more power than Police when it is covered by The Environment Act

Agree with that especially for a year. Most people have to do something at some point on the roadside but your neighbours dont know that it will ever be finished unless you have a timeline on the windscreen

You might also find the reason they didnt come to you directly was because they might have you assumed you would tell them to piss off and if you did and they went to the council, you would know who it was.

If you lived oppisite me there is NO WAY it would of been there all this time. I'd of helped you fix it up and had it sorted. Some people will find anything to moan about.

DOES it actually need MOT

An MOT proves the car is in a safe state to be DRIVEN on the road, aint exactly like the brakes are gonna fail or a bearing collapse and cause an accident.

BUT

you pay tour tax to allow a car to "use" the road (and you only want to use it for parking on and not damage it by actually driving on it )

And Yes the car MUST be insured to be parked on the highway as it could be involved in an accident, ie someone could walk into it and sure now days they would be able to sue you somehow .


Personally I would spend a couple days "looking into it", if for no other reason as to not be seen backing down to some old missery gut neighbour
