I was allegedly caught speeding in Nottm in Feb

I asked for a photo which was piss poor , Here is my response to the fooookers

Dear Sirs
I am writing with reference to your allegations of my breaching a 30mph speed limit on 15/2/06

I have a number of issues that I feel you should be given the opportunity to respond to.

I have asked for a copy of the evidence that you say you have available for which you have furnished me with a low quality small black and white image. From this image it is impossible to draw any of the following conclusions

• The fact that the car in the image is mine,all I recognise is the number plate and this could have been “cloned” at anytime
• At the time of the alleged offence I believe I was at my sisters house in Nottingham with my partner and my 9mth old son
• The image of the driver is purely black screen with no way of identifying the driver which in my last correspondence I informed you of the difficulty in knowing who may have been the driver
• You also have sent me a NIP in the last 3 weeks for a vehicle M111JPH that I sold 3 years ago and the VRM was sold separately yet you still manage to have me as the registered keeper of a vehicle that doesn’t exist. Yet you want me to accept the accuracy of your process

In light of the above facts I cannot at this time with any degree of accuracy state that my car is the one in the alleged letter, whom the driver was at the alleged time

If you consider further action under Section 172 of the RTA I would request a stay in any action until the outcome of the following case is heard later this year by the court for Human rights, Then based upon the outcome the action should then be re assessed.

Eight Motorists' Right to Silence Defence to be heard by European Court of Human Rights.
The European Court of Human Rights has accepted eight motorists' applications claiming that S172 of the 1988 Road Traffic Act breaches the right to silence implicit in Article 6 of the European Convention on Human Rights. Given that 90% of applications are rejected at this first stage, this is an important step in a process which, if successful, will make the speed camera system unworkable.
The British government has been asked by the European Court of Human Rights to respond to these applications by January 18th and 19th 2005. The applicants will then be able to respond in turn and a court verdict is expected some time in 2006.


If you feel that the action you need to take will not be either overruled or prejudiced by this case you have my details

but, they wont care, you might be lucky and they drop the case, or you might just get a summons.

have you taken any advice from these guys? www.forums.pepipoo.com as they know thier stuff.

hmm, red light in a carpark, are they serious, why is it given such a high profile?

I would write a letter to HR telling them that as they have no positive video evidence and the fact that as a member of the public, the security guards statement is not primary evidence and therefor would not stand up in a court of law, they cannot discipline you.

I would ask for thier comments back to you in writing too.

also state that as no evidence of identity was given, they should remove all pertaining documantaion from your file, unless they want to take it further, legally speaking

they have a security gate that you go through before said lights and this opens after you scan your card over the reader, this logs your details and time, BUT when this system was installed they said it would only be used for security purposes and NOT for disiplinary reasons, they didnt mention the use of my card in the hearing, but you can tell they've used it to check up if I left at the time they say I left

Well now i have got a leeter from the plod

This office has requested that you the user/keeper of Audi A6 1.9 TDI did not comply with your duty under section 172 of the RTA 1988 by providing the required details of the driver of that vehicle at the time and date relevant

Having considered all the evidence it is felat you have failed to give the information required , This is an offence

I must therefore advise you that in the next ten days a file will be raiesed and forwarded from this office for consideration of your prosecution

I gave the details of someone driving my car who had sinced moved abroard and i had no forwarding address for cause they were backpacking (or iddnt exist, i cant remember now )

They said they were going to do me for failure to identify, but i pointed out that i HAD identified but the person had since moved, they realised this was me meeting my obligation and dropped it.

Yours isnt as cut and dry as that, but i still dont see how they can penalise you when you have genuinely been trying your hardest to co-operate.

Especially as no doubt you have a few witnesses that the car was where you say it was, not driven by anyone, parked on the driveway.


Maybe you should have been more specific about that fact?


At the time of the offence (by my watch, which may be wrong, so you can prosecute me for lieing, its not an offence for my watch not to be calibrated to the local speed cameras) the person driving my vehicle was "NO ONE" as it was parked.

I have also sttated that your picture doesnt clearly show the car has being mine

what they will do is look for any sort of identifiying marks on the vehicle that match those in the picture

if you've got a sticker in the window or a little scratch on the bumper or whatever

thing is, they can't enhance the image they got from the camera and present that as evidence, so if you DID have a blue sticker in the window and they DID have a blue sticker in the window of the car in the picture, they couldn't enhance the image to see what was written on it to see if you DID win a blue peter badge and were proudly displaying the fact in the rear window of your car

but plod do tend to have a habit of "looking" out for people who try to wriggle out of cases as watertight as a sieve later on in the day round my way so even if you do end up getting your costs paid.............

as a matter of intrest, where baouts in notingham were you alegedly caught?
they have more cameras than anywhere else i've been to

Chip Nope but she repeated it 2 to 3 times and said the calls logged so ill be asking for that in court

Data protection act only counts if you can only get the drivers name from a PC based system and Data P act is very weak on this

They have saoid they cant tell

if you can say the car wasn't there when they say it was, and they can't id the car other than the plate, i'd say you've got your basic open and shut case of them not being anle to proove it's either you OR your car in the picutre

Its your LEGAL RESPONSIBILITY to know the driver of your car at all times and be able to present that information to the police.

If someone wont give you that information, or let you share it, then you shouldnt be letting them drive the car.

You are also responsible for them having insurance etc (look up code IN12 on the web if you dont beleive me!)

The data protection act is of utterly no use here, especially as police can apply for an exemption whenever its in legal proceedings anyway.
