just read in paper that if people try to claim money and take Alliance & Leicester to court they will closed the accounts within 30 days
http://today.reuters.co.uk/news/news...NANCIAL-AL.xml

Looks like it's only if you turn your nose up at a settlement, which I think would probably be unwise anyway...

Which on the banks part i would say is a perfectly reasonable thing to do as surely you cant expect all the money back as you've still been partly to blame by incurring these charges in the first place

Good idea mate - get some money back, but don't worry about clearing your debt....

Get a cossie, and get yourself in more!

Knew someone would pipe up with that. It's a fair comment but I'm happy witht he way I'm paying things now so it's not an issue for me. Anyway, we're going off topic. Let's stick to the matter at hand

... but mate, this IS the topic at hand.

The fact that you'd be prepared to buy a cossie instead of paying off a debt is why you've probably racked up so many charges in the first place.....

It's all well and good to be able to claim back charges etc, but I'd far rather be in the position where I didn't have to.

No, not really. I've just had a hard time the last 6 years, mainly because I moved out at 18 when I wasn't mature enough or financially ready and it all stems from there. My life would have been very different had I stayed at home. All being well I will be earning £2.5k a year more from July so I don't see why I shouldn't buy what I want, providing I make sure all bills/monthly payments are fulfilled first each month.

Why? Because you shouldn't view a monthly payment to a creditor as a bill.

Not having a go mate - I have just been there - I got myself in a LOT of trouble when I was younger over money, and it cost me a lot.

Plus I have actually OWNED two cossies, and I am telling you now. Being able to afford buy a cossie is not the same as being able to run one!

Dear Sirs,

I'm very disappointed that I have not recieved the reply from David Presland as promised within 7 working days from the date of your letter (02/06/06) regarding the refund of my bank charges.
I hereby give a further 3 days from the date of this letter to reply to my complaint or I will begin legal proceedings.

That's in the postbox now ready to be delivered

there was a financial expert on Lorraine Kelly show this morning, and he was telling people to do this exactly as it is has been explained on here.

He said he was getting 20 -30 letters or emails a wek saying that someone had had their charges refunded. Simply put he said to charge someone say a few quid for a letter is acceptable, but to charge for example 30 for the letter isnt acceptable.

this seems to good to be true.
i've had a bad time with money over last few years, so i feel i should be entitled to some of the charges back what i have paid.
gonna see about getting my last 6 years worth of statements and go through them with a fine tooth comb
thanks for the info

Well I'm fuming. I took too much out of the bank and missed my phone bill (first DD I've missed in at least 8 months as once I got working again I started making sure everything got paid) so I went in with the money for the bill and to ask that they refunded the charge. I asked for it as a goodwill gesture as I'd not missed a payment for ages rather than going down the OFT ruling route but he wouldn't refund it. So then I fet I had no choice and explained that the OFT had ruled these charges unfair and that they were not legally enforceable yet he still wouldn't refund it. I know I should have kicked up a fuss and asked for the manager (I'm not even sure this idiot understood the law) but I just couldn't be arsed and walked out.

Now DETERMINED to get my money back.

No you shouldn't Jay.
The ONLY thing you should be doing is putting it in writing.

Do you really think a bank clerk has the authority to authorise refunds on your account.

If they have an option of getting out of it, they will. Understand, reclaiming these bank charges are tantamount to prepping a small claims effort.

try telephone banking or a personal banker for individual ones, clerks are useless and cant do anything.

if no joy, writing all the way

Well I have had them refund a charge once before. Was about 4 years ago now, I think. Although I can't remember if it was mine or the bank's error on that occasion
