Default Mondeo 2.2 TDCI need advice about where i stand with garage i bougt it from

Had it a week , it started missfiring so i took it back , they cleaned the EGR & has been fine for 3 weeks . Now the glow plug light is flashing & it goes into linp home mode . Going to phone them tomorrow , but want to know legally where i stand, before i do . Paid the full screen price cash & they took my old Zafira in part ex. The garage was reluctant to look at it last time thats why i need advice. Thanks

They're probably reluctant because that sounds like an injector fault, and they are bloody expensive to replace. Thankfully mine are still okay on my car but mine always gets long runs, but if you need a full new set you won't see any change out of a grand. And they need coding to each cylinder too.
But it needs to go on a diagnostic check first to get the fault codes. It might only be one it needs.

speak to them without being a cock,

be reasonable, they fixed the fault and it was fine for 3 weeks wasnt it.

if your sensible and work WITH them they will help you, go in threatening to drive it through their front window and they will do fuck all matey

but you do have rights, but be POLITE

thats rich coming from me but i have worked in the motortrade all my life so ive seen both sides.

But why should i pay to get codes read , can see this being a bad head . cost me Ł50 in diesel & a train last time i took it back . Garage is in Newcastle & im in Carlisle . Garage is called Motor Port when you go on their site it says all cars come with 3 months parts & labour warranty .

You borrowing the money isnt anything to do with the garage though so that's not relevant.

Fact is you have bought a used car with a stack of miles on it. Shit is going to go wrong.

We sell 3 year old motorbility cars generally with sub 30k miles and they have faults from time to time like the Quashqai that snapped a timing belt at 20k and took the valves with it. We too offer 3 months parts and labour which we take responsibility for.

People that wipe themselves out to buy a car never cease to amaze me and i see it on a daily basis. How can people not factor in fault costs? What would you do if you were 4 months in to ownership and this happened?

Thanks Carlos , i am a self employed window cleaner , needed a car for work & we go to France every year with the kids , so needed a diesel . I am Ł100 a week worse off than i was 5 years ago .

wish i had kept the old zafira , had it 9 years , cost me nothing but discs & pads which i can do , bought it 2 year old with 116000 on it wish i had spent a few quid on it and kept it , it had 260000 on in but took us to france in august . It was just getting tired .

Oh no, I wasn't saying you should do it, they should be doing it. You shouldn't be doing that sort of thing. Sadly the TDCI engine generally does suffer with injector problems, they're great when they're running well but a pain when they're not.

If your doing around 75k miles per year (said you did 150k in 2yrs with your Zafira) then I'm sure I'm not alone in thinking you shouldn't have bought a TDCi Mondeo !
Around 100k is when the dual mass flywheel tends to shit itself and they are also very prone to injector and fuel pump faults so I would be prepared for the worst mate !!

The garage you bought the car from should stand good for repairing any problems with the car though so as mentioned above the best thing you can do is remain calm and take it back to them and give them a chance to sort the fault, if they are a half decent place they will sort it, if not you could be in for a struggle I'm afraid.

Pester the service dept as well.

My mondeo the sales team were fucking terrible at sorting some bits but the service team were bang on. Even went as far as to sort me a courtesy car but I was working away and didn't need one.

Hopefully you can get the same.

Id get legal advice before the 3 months is up. I very much doubt the garage will offer to fix it as they know it'll be expensive. They will drag it out so after 3 months your

Well just phoned again they said the 28 days warranty was up . It states 3 months warranty on their site . which i have printed off incase they change it . So he said we wont fix it , i then stated that i had been to CAB & know my rights under the sale of goods act . So waiting on them to get back to me again.

I'd say that because a fault existed quite soon, which you (in good faith) believed was fixed, only for the car to become faulty again, suggests that this may have been intended as a 'bandade' fix, perhaps to get you past this four week boundary of theirs.

I believe the acceptable term is 90 days for trade sales as consumer rights - as the link says, their 'warranty' is additional to your statutory rights, so don't worry.

It is hard making money from selling cars as the margins are tight and issues unpredictable, however they still have to abide by the same standards as other professional tradesmen.

Make a note of every phone call and conversion, what was said and when. Their warranty is completely irrelevant, you're not claiming off their warranty, but are using your rights that EVERYONE who buys a car from a dealer has.

It's failed so soon after buying it that you are covered by the Sale Of Goods Act. You have to give them the option to fix it first, if they don't you can get it fixed elsewhere and bill them, but I suspect that would be very difficult!

You need to read up on the Sale of Goods Act, and if necessary get legal representation - Whatever you do DON'T just rely on what you're told on here. As far as I'm aware no one here has any legal training.

As for the comments about "what do you expect buying a car of that age" - Well, if you buy from a dealer one of the reasons you pay a premium is that you're covered if the car fucks up! The question should be "what dealer in their right mind sells a 100K Mondeo TDCi" !!

Well been in touch with trading standards & they say i have a strong case under the sale of goods act . Been back in touch with the dealer , he said the usual boss is not here , i ask again for his phone no , he wont give me it . I think he is the boss & trying to stall me . So told him i had been in touch with trading standards & gave him till 12pm on the 19th to phone me & resolve the issue . if not i will be taking him to court.
