Default red light offence ?

hi my brother has had a letter through the post it says section 172 traffic act 1988 the details are the speed of the vehicle was 37mph in a 40mph limit the time into red was 1 second the amber light having previously been on for 2.9 seconds
the offence says : failing to conform with the indication given by red signal

what shall he do ?

does it not have a form with it saying to name the driver????

Normally they expect you to name the driver.

It shows the speed as some of the cameras are speed capable as well as doing red light duties.

well if it was him driving he needs to fill it in and take the 3 points

if he doubts it he can ask for a photo, but usually the evidence is damning.

well no harm will come from asking for the photo but if he did go through the red then he has little chance of getting away with it to be fair. This is why they fit the scameras to give evidence you cant deny!!

In other words he had about 3 seconds to slow down from a yellow signal and took a further second to breach the red so he was about 4 seconds behind the red light. Don't know the circumstances of the situation but that is plenty enough time to stop imo.

yoiu could believe some of the old wives tales you hear and fight it but if he did it and it sounds like theyre right on the ball with it then theres no point.
take the 3 points and the fine.

Thats the only points i have on my licence, bloody annoying as i cant remember doing it. With the amount of traffic lights on my route across london, i suppose i was gonna do something eventually cos i get frustrated with the lack of progress!

Need to fill in the S172 reply form with driver's details and then see what happens next. He might be lucky and not hear anything further but unlikely.

oh well bit more info he went to the cop shop and asked for the photo and they said they havent got 1 but he has to ring up monday

I was always under the impression if the back wheels went through on red then you got done,i.e the light was red pretty much WHEN you got there.
To me,three seconds on amber is actually a reasonable amount of time to think he could make it,he was driving well within the speed limit and because of the icy conditions felt it was unsafe to stop suddenly.
Yes,it's easier to take the fine but if I were you I'd have a good look at the photo first,if your cars near enough all the way through on Amber and just the last little bit is through on red it maybe worth contesting it.
However be aware they are total wankers and will probably end up doing you for it anyway.

the sensors on the road are set up in the position that is considered "legal" to do someone so you wont be able to contest on that point i suspect.

If my maths is right in those 3.9secs at 37mph he covered 211.64ft. That's just short of the highway code stopping distance from 70mph. I don't see how he can fight it. Even on ice from 40 I'd expect him to have lost more than 3mph in 211ft if he made any attempt to stop for the light.
Even trying to argue the "amber means stop unless to do so would cause an accident" case would be abit lame as from 40mph 3 seconds isn't exactly an emergency stop.
