Got a letter today of the Whitness care unit, thats a laugh to start with.
The fooker who stole my transit in January was at court last week, not only did he admit stealing my van, but he also missed the first court date.
Anyhow he got 80 hours community service and was ordered to pay £250 compensation.

Now if he has admitted stealing the van, how come he has got off so lightly even though he wouldnt say what he did with it?? It has never been found, and i didnt get paid out as the keys where in it ,even though i was 16tf away. Some justice, anyhow i can appeal the decision.
So i am roughly 7k down, and this tosser is getting fookall.
Do i appeal??
i have his name and am thinking i will sort it my way ??

i had a van wrth 4kish and the contents stolen, roughly 7k depends where you shop, could easily add up to more

 

Your gripe here is with the courts sentencing guidelines.

Compensation is means tested, he will be a unemployed bum with no money I bet. Doesn't your insurance cover you?? Did the police send you a request for compensation form (think it's called MG19)? What did you put on that form?

As far as 80 hours community service, although there are a number of factors that go into the mixing bowl in coming to that decision, it seems a level of punishment I would expect. I feel an appeal would fall on deaf ears, and/or be a costly exercise.

What I'm saying is nothing seems out of order here really, and I have some quite considerable knowledge on this

If you were lead to believe the Magistrates' would be awarding full compensation, then it is not really their role. You should persue the matter through civil courts perhaps instead of apealing. You could use the evidence of the criminal case to proove the matter and they could make him pay.

See a solicitor, all is not lost I believe

Cheers for the advice mate , i did not get a compensation form. My insurance refused to pay out due to the keys being in it , even though i was no more than 16ft away in the road talking to a delivery driver .
Will sortit when i come backoff holliday next week

 

As the court had no evidence of your claim, they have awared you a notional amount.

I would see a solicitor as soon as you can, there could be more than one avenue you could explore possibly.

It is no certainty you will get more money back, but there is a chance.

 

80 hours community service is not a reasonable punnishment even if the gay sentancing guidelines think it is.

 

As much as civil litigation is a good idea ... if the defendant is "an unemployed bum" then you will be wasting your time. If he doesn't have the money or assets to satisfy and judgement then it will be be unenforcable.

You could be throwing good money after bad so to speak.

You don't need a solicitor for small claims court either, it'll only add to expenses.

I'm not being daft but I always feel it's a cop out when they won't pay due to the key situation. Did you give him permission to go for a spin in your van? No! End of. Still theft IMO bit more involved if they didn't catch him as obviously your mate could have pinched it for you blah blah and all the stuff they would accuse you of
I have a customer with a large collection of cars which all have to be left with keys in by order of the insurance company incase of a fire and how long it would take to find each key and get them out to safety
They choose the rule that suits 'em

 

I would have thought that only 16 feet away, and the fact that you don't mention seeing him get into the van must mean the van was out of sight ?
If so you shouldn't be paid out by insurers imo, as you haven't taken "reasonable" precautions, like the idiots who pop into a newsagent on the way to work etc and leave the car running unattended outside, some get paid out, pisses me right off, although I realise your situtation was not as inviting to the thief, I would not do this even on my own drive with me 10 feet away looking at the car.

its a total piss take clive, i know its different but when my car got broke into they found the scum who done it they both pleaded guilty went to court and got community service etc i got £80 compensation ive had fooking £7 quid paid into the bank in 5mth.

 

an asshole broke into my garage and torched my rst cabby,couldnt get it started so lit it instead,he was caught and charged,he got a similar fine and i got a grand total of £0,i lost my car,garage as the council boarded it up for years and all the things in the garage.i wasnt insured as the car was off the road for the winter so i was down around £4000 between the car,tools and other things in the garage.the guy had no job and the only way for me to get any money would have been to take him to court myself.no point as he would pay whatever out of his giro at £5 a week forever.thats the criminal part.i feel sorry for you.i would go and ask what he did with your van and all the tools inside myself,and take a few friends just to intimidate him.

 

If you want your insurance company to pay out you must try the Insurance Ombudsman, have you done this?

The fact that you were 16 ft away for a short period of time may very well go in your favour, but you must involve the Ombudsman, contact details for them will be provided in your policy documents.
