Just so you know.

They cant take a car that is not owned by you, Once the Logbook is singed over, and sent off, the car is no longer yours and is mine, In thoery, but you own the car in any view, once everything is clear, then whome ever it is, hands over everything and the only thing it gives is a few more owners, tuff luck on more owners, but you get to keep the car.

They cant take a car that is not owned by you
- The car is owned by them, so they can do what they like

Legal Owner = Finance Company

Registered Keeper = Name on Logbook (Rupert).

So changing the name on the logbook won't affect anything.

if you have defaulted on the finance agreement on the ST they can and will reposess it.

They have legal title to the vehicle until its paid for in full, no mater who's "looking after" it.

If its only the ST on finance they cant take anything else back as they have no entitlement to

i thought the car was fully paid for. Not on loan, so yes, they can take it even if its owned by someone else. but i thought it was all paid. and they was taking it as part of payment on something

I KNOW PEOPLE WHO HAVE VOLUNTARILY handed cars back to the finance company,a mate who was skint turned his car back to lloyds black horse at british car auctions manchester, they would of picked the car up and charged for the privillage (Ł150 iirc!!) he couldn't even afford the fookin tax, still owes me 500 quid i am owed from the gran i borrowed him.

i would never have car finance ,buy somthing you can afford and its yours and only yours and work your way up the car ladder.

very unfortunate lad but is it unfair , no.

you borrowed and cant repay so they need to cover their costs.its a business and not a charity.
sorry to hear your out of work but things are starting to turn,im also out of a job and hope to get some thing soon.

Dont forget it may be harder for you to get finance in future as you have defaulted on this credit agreement, it will be recorded on your credit score and will be looked at next time credit is needed.

my mate tried selling the car and would of paid the finance off but fook me he is hopeless,i have paid finance off on cars that the owner isn't even in difficulty with, its not rocket science.
whats the car worth trade ?? whats it worth retail ??? whats it worth private sale???and how much do you owe ??? you may be able to do a deal getting the car sold that helps you. a finance company will only sell your car to claw back bunse so why can't you do it eh???

sticking your head up your arse will not help in the long run.

best of luck

look mate i'll spell it out......

if you owe say 6 grand and can get 7 for your car yet you can't fookin afford the Ł350 a month all in or what ever it is every month, try selling your car.

tell us the age, letter and miles and if its got a higher spec or somthing.

if you said what you owed someone could do the maths and see if its worth you selling the car and paying the finance off.

if you have give up and can't be arsed divulging the info,at least i tried to be helpfull, its like i have seen this shit happen and peoples heads go down and give fucking up.

I reckon trade is approx Ł6875, depending on condition, retail price would be approx Ł8k...

What you owe on the car?

Be careful, they may take the car back, then sell it at auction and you will STILL OWE the remainder on the car.

If it was just a case of taking the car back via reposession you could give it back.

I would STRONGLY suggest having a chat to them and citizens advice as I think your about to get double tucked up.

Overpaying due to finance, then they take the car back, get 4k at auction and chase you for the remaining 6k.

oh dear. Looks like you gotta bite the bullet mate. If they fetch 7k in the block for the fiesta, you'll still have to pay the remaining 3k somehow

You may be able to extend the term and the repayments on 3k will be much lower than those at 10k!!!!!

If a car was stolen, worth 7k, yet the finance was 15k, the insurance on the car would pay out the 7k, the gap insurer would pay out the remaining 8k to clear the drip.

i would imagine.....

or if it was crashed really badly, beyond repair.

BE CAREFUL AGAIN, it is illegal and the police aren't daft and may seek action if they feel that all is not right and may inform your insurance, then you have nout!

why not just call the finance company, explain the situation and see what can be done.

Maybe a call to citizens advice first to get clued up on your rights before you call them.

At the end of the day they want their cash, and so if they can work something out it is better for them and you.

I would say letting the car go would be a last resort imo as it will leave you deeper out of pocket.
