Default Non fault accident advice..

My friend has a MK3 XR3 which is pretty tidy,

Today some still bint revered into the quater panel and door,
On checking the damage, it needs a rear quater and a door,
plus paint etc etc...

So, he had it valued for £1,000 on the insurance,

What i want to know is, if the car is a "write off" which i am sure it is, can he refuse pay out and demand it to be put right?
as he does not want a new car he wants his mk3 put right.

id guess it will be a write off. possibly worth taking the settlement then buying it back very cheaply from the insurer as a cat c or d to repair yourself?

in most cases you can get the money & buy the car back..

I guess it depends on the damage and excess, but demanding the damage to be put right is likely to be out of the question as ford no longer produce the original panels for that vehicle ?

he wont be able to repair it himself,
and im guessing a quater panel is en expencive labiour wise to replace?


so he can stipulate he will take the pay out on the condition he keeps the car for the salvage price?

he wont have a problem with pattern parts as we talked about it.

His insurance company doesnt need to know a thing if she has accepted responsibility, This happened to me on my bike, didnt need to tell them and got the bike paid for, kept it and got a payout for a sore knee. As for her insurance company making it a write off, dunno, why should they be able to do that, just get counter checks done and make sure they say it isnt wrote off.....

See if they will just give you the amount they value the car at less the salvage and let you get on with it.

Technically thats a breach of the terms and conditions as im sure your policy they asked to know about ALL accidents wether fault or non-fault.

Yes its unfair that you get fucked and a hiked premium despite it being non-fault but thats the way it is. (fucking government should step in IMO).
