Friend of mine was arrested on friday night in a club toilet. They found a bag on his possession, with nothing in it. The door staff advised the police his eyes were glazed over (he'd just done a 10 hour shift and gone straight out).

Police arrested him, released him with No Futher Action, but they have sent the bag away for testing.

Now 1) There was nothing in the bag, he had some ephedrine on him to liven him up which had gone. So no drugs what so ever.

2) I saw that bag on the floor, so not sure he had it on him - If the police have found an empty bag on the floor of the cubical - and this tests for Cocaine, what sort of charge will be face?

If the bag is empty surely there isn't enough there for possession? He demanded they did a drugs test on him but they wouldn't.

Also - if the bag comes back testing ephedrine what charge will he get here?

Sorry for the long post I'll post bullet points:


-Arrested in club cubical for appearing to be twatted on cocaine.
-Empty bag found on possession
-Bag had dust from ephedrine tablets in.
-Police testing bag expecting cocaine
-If bag was found on floor and not his, and does tests for cocaine what will he get.
-If bag tests for ephedrine what will he get.

theres holes to be blown all over that if he did wish to fight any possible charge but even if he did get charged with possesion and guilty of coke, im assuming its a small 1gram bag? possible a fine of a couple of hundred max? but without drug tests theres no proof it was his.are you sure they are really testing it or likely theyve just binned it and given your mate a frightener?

 

Well this is what I thought, they rang him Monday saying the bag is being sent.

Sounds to me as if they're just scaring him, surely a drugs test would make or break it? i.e either convict him, or get him off it. But I guess it's "possession" whether he has used it or not.

 

nothing will happen, theres no proof it was hes bag, he just finished a 12 hour shift

ps: where was this club,,, as i NEVER NEVER NEVER EVER wanna go clubbing there EVER !!!

ive been caught a few times having a line and the worst thats happened is ive been chucked out,,, one bloke even said to me " mate if your gonna do it one at a time in the toilet,,,,, try and hide it a little bit for us"

getting arrested for a empty bag and under the influence of dodo's chesteze,,,,,, i take it you life in a area where there is no other crimes take place anymore im guessing nobody drives anymore hence they have to me so strict

 

It was in Chorley, we'd never been there before! There's only one club there!

so there listening to the door staff who are probably buzzing there tit's off on fet that he looked monged on coke and there was an empty bag on the floor in a club toilet that your mate just happened to be in and he was also refused a drug test.

Fuck all will happen, end of the day if the bag did contain coke his finger prints would be on there, if there not then no case, unless he was trying to blag his way out and it is his.

 

If the police arrested him, did they take finger prints ?

If they did I would have thought if your friend had been in contact with said bag it would also have his prints on it, as already stated.

 

Yes they took prints - but that is the norm now a days as far as I'm aware..

 

they take prints and dna swabs, just in case he's a mass serial killer they not been able to apprehend for the last 25 years

You say it was in his posession and you also say it was on the floor?

 

i think there may be 2 bags invovled here

 

Possibly two bags.

If they found one on his possession it had ephedrine (fat pills) in.

If they found one on the floor, then feck knows what is in it.

 

Tell him not to worry. The CPS won't even think about letting it go to court!

 

Id imagine that is the case too, the police are probably just going through the motions.

Nothing will happen. How can they prove you have the 'stuff' in the bag. The bag could have come from anywhere and belonged to anyone before.

All you need to say is I dont know who owned the bag before me, err....found it at work and used it to keep my money in when I go out as I keep loosing it.

It may of had the 'stuff' in at some point but not when I had it.
