am so fucked off at the minute! On saturday night some dickless piece off shit overtook a car right in front of the junction i was about to exit from and hit me!
As i approached the junction i looked left to see two cars approaching and looked right to check if the lane i was entering was clear as i was turning left! All was well so i looked left again to see that the two cars were no more than 20ft from the junction all seemed fine so i went to pull away! Just as i did the second of the two car swung out to overtake without indicating or anything! He clipped the front drivers side of my car damaging the bumper bonnet, headlight and drivers side wing of my beloved s2 rst of which i have spent thousands! Now you all must be thinking "well its his fault right" wrong! For starters the car the guy was trying to overtake didnt stop so no witnesses, When i rang the insurance company to tell them about it they told me that the guy had said that he wasnt overtaking he was just driving along minding his own buisness when i pulled out of the junction n hit him which is total bollocks! So hes saying i'm at fault! I took pics of the incident which i have been told are no good because they dont prove anything as they could be pictures taken at anytime! My girlfriend was in the car but dont count as a witness because she aint independent! Basically i'm fucked and the best i will get is a 50/50 settlement which means i still have to pay my access n still lose 2 years no claims! And to top it all because its an e reg escort they will probably write it off! God i'm so pissed off with lying dirty lil cunts who get away with murder!

 

If it was in a built up area, check about for any CCTV / security cameras that may have been pointing that way.

Same thing happened with my mrs last year. She was pulling out of a side road and some cunt came flying round the corner (30 limit) way too fast and hit her back corner. If he was obeying the speed limit there would have been time for my mrs to see his coming round the corner.

Although he was speeding, he hit her and flipped her car round 180 degrees in the road, his speed could not be proved and it went against her on the fact that she pulled out in front of him.

Afraid you don't really have a leg to stand on mate. The insurance company won't write your car off tho unless you ask them to pay out for it.

yeah but i didnt pull out into his lane he was travelling the other way i pulled out turning left and he has pulled out to overtake hence pulling into my lane! dont get me wrong i know what your saying n i aint getting funny with you, just seems totally bonkers that someone can overtake infront of a junction and not be in the wrong!

 

as much as i wanna burn his house down with him in it if i do anything its gonna go against me!

plus my girlfriend got whiplash in the accident but cant claim because if she does n the outcome says i'm at fault the only way she can claim is off my insurance which would make my premium even higer next year!

yeah belive me i am coz insurance company said that if i had a witness he'd be bang to rights! but people are not legally obliged to stop its only commen curtisy! plod told me that coz i rang em to see if any one had come forward!

 

Ok, were the police called ? Does the fact that he didn't stop at the scene of an accident count for anything ? What car was he driving ? What damage was done to his ? The police can estimate the situation given the damage to your car and where it happened. From one point of view it simply looks like you saw too cars coming, thought "I can make that" and went for it, but was too slow and got hit side onwards.

The flip side is the guy approaching the roundabout thought "fuck this, i'm round this cunt" and overtaked into the side of you on the roundabout. Hindsight is a wonderful thing after an inncident, but there's a lot of people on the round with a complete lack of driving sense.

 

er.... the only person who didnt stop was the car the guy who hit me was trying to overtake, n also i wasnt at a roundabout it was on a straight piece of road n i was exiting a junction! n i didnt pull out infront of him as i was going in the oposite direction he pulled into my lane!

anyway you see why i may not want the bumper straight away as it might get fixed by the insurance company but if not i will be needing it! pm me with price and contact number!

he didnt leave mate, he stayed the only car that didnt stop was the car he was trying to overtake, hence why i dont have any witnesses!

 

Sorry mate, but I think you are in the wrong here.

He should not have tried to overtake on the approach to a junction, but you have a duty to give way to traffic already on the main road and might have anticipated that he would attempt an overtake if the road was straight and clear.

For what it's worth, I drive assuming every other driver is a complete cock and so far I haven't hit or been hit.
