Afraid its just a case of your word against his. It will go his way because you pulled out into his path.

Same thing happened with my mrs last year. She was pulling out of a side road and some cunt came flying round the corner (30 limit) way too fast and hit her back corner. If he was obeying the speed limit there would have been time for my mrs to see his coming round the corner.

Although he was speeding, he hit her and flipped her car round 180 degrees in the road, his speed could not be proved and it went against her on the fact that she pulled out in front of him.

Afraid you don't really have a leg to stand on mate. The insurance company won't write your car off tho unless you ask them to pay out for it.
