Ripped off by a contractor!

I have recently gone self- employed in the security industry, alarms, cctv, door access etc.
I got contract work off a bloke i know working on 3 schools. Good start.
All was going well until, wheres my fuckin cheque???
Now my saff has to go to keep me afloat! Even more frustrating is that i started to poly bush the front end and only did the nearside. I need a quick sale so i cant finish it!

unfortunately that can happen in the self employed line of work. fortunately its not happened to me and my mate in the 4 years weve been self employed.
its always better when theres 2 of you working together as theres strength in numbers and especially helpful to both be big angry skinhead types.
how long had you worked for him for? much of a loss?
go back around to remove everything youve previously fitted.

unfortunately that can happen in the self employed line of work. fortunately its not happened to me and my mate in the 4 years weve been self employed.

Only a couple of months but enough to get through the immediate spare cash and now my saff! If he doesnt eventually pay up then im going to kick his arse!

a couple of months unpaid will be a heavy hit for you to take. even if you get squared up give him a smack anyway for fucking you about.

you worked a couple of months with no payments? i dont know if your games different to ours , were self employed joiners working on price work and we put in our draw off the total contract price on a weekly basis depending on what weve done.

The jobs are still running and im in a good position to fuck it up for him. But my saff will have to go due to late payer!
I'll get another though when im straight again!

i had simular situation recently but only for Ł750 and me accountant said he use to wor for revenue and customs, he said he'll send hem a letter saying if they dont pay up within 10 days he'll write to revenue and customs fraud squad and 9 out of ten times he says they pay to keep the tax man off thier back

You cant go and remove things you fitted. He can then do you for theft/vandalsim etc. Just cos you fitted them you are not entitlied to do this.
Ive been here with late payment and im afraid unless it is stated in writing that they must pay you with XX weeks/months etc then you just have to wait!
When i quote for work now, i always put on the bottom of the quote that our payment terms are strictly 2 weeks from issue date, if you accept this quote then you accept our terms.
They have to pay you then or you are legally entitled to charge interest!

if you dont take them off site its not theft and if you remove it neatly then its not vandalism.
whether its legal or not sometimes a threat is enough.

Hardly a threat though that is it? If some sparky uncoupled things he had fitted neatly and didnt remove them from site i would just pay someone to couple them back up and knock that off his wages!
were not that big though just 6 foot and 13.5 /15 stone .
if he's saying hes going to pay then its not worth risking losing payment just yet. give him his chance to pay and if he doesnt you take it from there.
if hes not going to pay you have nothing to lose as long as theres no other witnesses.

from experience you can not remove items from his property regardless of if he has paid for them or not
i got stung a few years ago for over 5k for bathrooms and a boiler,i ripped the lot out with my mate and disposed of it in the firth of forth
luckily the copper who arrested me was quite sympathetic and even passed me his details so i could pay him a visit!
if the site is always active and you stand no chance of getting payed just snip every wire in the place when no ones about....serves the fooker right

Use the Late Payment of Commerical Debts (Interest) Act 2002 - you can send him a statement of account listing:
- the amount he owes
- a penalty for being late - Ł40 up to Ł1000, Ł75 Ł1000-Ł5000, something else for more but cant remember how much
- interest at 8% + reference period base rate (currently works out to about 13.5% IIRC) annual (non-cumulative)
I normally say that if they settle within 7 days the penalty and interest will be waived and the original invoice value accepted in full setttlement....

thats also a good plan. it will come back to haunt your boss as the main contractor will expect it all fixed out of his pocket.
ive been SE for 5 years.... sometimes ive had to wait 3 months for payment...
when i invoice.. i put on the bottom that if its not paid within 14 days i will charge 10% per week untill it is payed..
usualy this is the best way to make it happen..

Sometimes you get paid late when self employed, thats life. As long as you get paid..............
