New style M.o.t question

A lad at work took his car for test today knowing full well it would fail
His current M.o.t runs out mid feb
His car failed with flying colours
Now the question is on paper is he still legal till mid feb or has today,s failure voided his current M.o.t?
If he gets pulled surely it would show up on the plods computor it has no m.o.t due to the new test being a on line database jobbie?

Im an mot tester and have never seen any kind of form or notice saying that if its tested and fails then this invalidates the existing mot which has not yet expired.
The car is still legally mot'd until the current certificate expires and dont think the fact that it has been presented for a mot before it expires makes any difference.

i think...in fact im 99% sure ,if the car fails an mot it has been classed as unroadworthy and shoundn't be driven,as it does void the current mot
unless it failed on a few items which can also be re tested for free. the thing is this has always been the law but if you got stopped pre on line tests there was never any proof the car had been tested ,all you would need to do is supply the in date mot and all would be fine and dandy.
but now with the new on-line system if the car fails they log it on the computer, so the police know it failed and will pull you for it.
i work at a ministry of transport training center and the guy was chatting about this the other day.

I was just wondering with the fact the new style m.o.t,s are online surely the police have access to the details which show that today the car failed an mot?
Thought this number plate recognistion thing they,ve got show,s mot insurance and road tax with having to stop the vehicle and wait for a producer?

the old MOT will still be valid, but the driver is aware that the car has defects and is unroadworthy.
if he's still using it on the road, then he will be liable for any accident that the defect causes (skidding on bald tyres for example)
I called the MOT help line on this a while ago.
The police would know before they have puilled him over that his car is not in a roadworthy condition, and he could be fined there and then.
Best tell him to get it fixed.

cocofireblade is spot on. He has a current MOT certificate so he has an MOT. However, his car could still be un-roadworthy but he would not be committing the offence of having no MOT as he does have one.
It may hav an MOT but as u say it failed another one. So therefore you would say the car is now unroad worthy. Im on the understanding that the police can question anything on the car if it appears faulty and asked for it to be checked by an MOT station. They can then take it off the road.
