Default Highways advice required

was out in the escos the other night and i caught the stone deflector, which pulled partly out of splitter. i seen the island at the last minute and i sort of like just rolled into it(i know its in the middle of the road but i was to busy watching other traffic nearby) theres no street lighting and with the other cars about it was very difficult to see. The island use to be used to support gate post but is no longer used and has sharp pieces of metal sticking out of the top. i had the splitter etc repaired last year when i got my bumper resprayed and was gonna replace wid carbon fibre ones( which im gonna do now anyway) im just wanting to know if there is any one responsible for this island as it serves no purpose now and quite obviously is an obstacle in the road with no bollards etc on it.

I know a friend got some money for damage from potholes by writing to the council about it but they will try and argue that you know the road being local etc and you knew it was there. Try going to the citizens advice bureau and take your pics plus one of the damage and see what they think.

Local authority/council? Unless that's private land (trading estate? carpet right etc?)

As it's in the middle of the road though...they'd just say you shouldn't have been driving over it...wouldn't they? If you wanted some Ł back for damage...
If you wanted something done about it..
Theyll probably just come out and stick another bollard in it so people can't catch bits of their car on it

my mate says he got Ł130 off the council cos he fucked his alloy in a pothole....how true im not sure

but theres people getting money for all sorts nowadays
so its worth a try & id drain them big time aswell

Not sure as it clearly marked with lines on the road ect and in a box jct with a jct @ the end of the road (im guessing 100yds ) so there just say you shuld have seen it ect as your speed should have been low as you coming upto a jct

sorry should have mentioned its just as you pull out of a junctin(to the left of it. i was only travelling at snail speed as i was emerging from the junction. it use to have barriers going across and its only purpose was to support them, now they are no more. stood and watched today and slightly bigger vans etc have to straddle it when they pull out of the junction.

Exactly. Damage to the highway...poor maintenance claims...you can't help driving through potholes if they are in the lane where you need to drive generally...

You can help rolling around over the middle of the road over hashed lines onto traffic islands...to hit that sharp bit you'd have to have been properly on it aswell...not in the general vicinity of it

im not to fussed about the damage to the splitter etc as it was previously repaired and colour coded to match the bumper, just means the escos's carbon fibre xmas pressie is coming early just a nice thought if some was paying for them. i doubt theres a cat in hells chance of getting genuine replacement parts. any idea what happens on insurance when you need to replace factory fitted parts that arent available no more. like if someone crashed into your front back bumpers.

its 35 miles away from my house in Carlisle. i know its there now by the looks of it i aint the first to hit it and probably wont be the last. the damage it caused was basically caught the stone defector and pushed it under the splitter pulling the holding screws bolts through the splitter ripping it, managed to crack a hockey stick aswell. as said im just after advice before i give creative carbon a ring and order my new ones.

If you report it they might fix it but under ''improvements'' as opposed to ''general maintenance'' to avoid having to pay out to people..

''Shouldn't be there'' is subjective mate. They'll argue that it was there before with a bollard which you'd have ''crashed into anyway''...it poses no danger to life and is clearly marked...the road surfacing they'd have to undertake to rectify it versus the low risk to person/property (as nobody should be driving over it, whether they are or not) isn't cost effective.

They did ''their bit'' as far as they are concerned..by actively taking steps to remove the bollard when the barriers were removed.

Onus is on you not to crash into it as it isn't in your lane I'd imagine...same as if you mounted the kerb the other side...
