Double Yellows and accidents???

Default Double Yellows and accidents???

If a car is parked on a double yellow line and you hit it, should it be your fault?

The lines are there because it is a hassard to park there so if you park there and cause an accident, surely it is your fault.

My mate is a truck driver and recently clipped a car as he came around a corner, it was a tight corner and the car was parked on the double yellows meaning there wasn't enough room to swing the cab round the corner.

My mate was blamed for the accident, but surely it was the bloke who parked on the yellows who caused the accident.

Possibly me talking shite, but it seems abit unfair, if I jumped a red light and someone hit me coming the other way, i couldn't claim they should have seen me.

If liablity could be blamed on the parker, people could just drive into cars parked on double yellows and claim on there insurance, if this was the case, nobody would ever park on a double yellow again.

If one vehicle is stationary any one is moving surley its got to be the moving one at fault!!

Common sense lad, truck driver at blame even though parked car on double yellows

Can't believe you'd even think it was parked cars fault PMSL

Nothing like not accepting your own fault is there...

You are always supposed to stop in the distance you can see to be clear. If you come round a corner and find a parked car, your speed should be low enough to give time to stop.

As above it was your mates fault he was driving and the other car was stationary. Pigs could possibly give the owner of the parked car a hard time over it but the blame won't be shifted

I'm thinking here that he clipped the car going slow as no room to get by, not that he smacked into it or anything

I know of someone who got the blame for an accident as he had parked his car on double yellows on a corner before.

In this case it was a head on between 2 cars and both parties agreed that the fault should be put on the driver of the parked car!

Strange but true - as said above, the blame will generally be with the driver of the moving vehicle but as with most things in insurance there is no hard and fast rule.

Ask him if he would have tried to squeeze through if it was a police car on the yellows (quite legitimate if attending an incident)...


And then tried to blame the copper

There really are not too many excuses for hitting a parked car, wherever it is.

im sure the insurance company will be on your side mate.he should never have been there in first place..same thing happened to driver in my work and the driver of the parked car never had a claim

I remember seeing a bloke doing his nut one day cos he'd parked his Galaxy in the bus stop, which was right tight as it was anyway, then a bus came along and caught his rear bumper and quarter

He came in the shop I was buying some bits from, wanting to take everyones names as witnesses, no-body agreed to it, then when he left everyone suggested perhaps he shouldnt have parked it in that big yellow box marked BUS, next to a shelter Idiot.....

I agree the car should never have been parked there...

Its the kind of thing that annoys me, you're allowed to stop on most double yellows if you're just setting down and picking up but not parking, so you should accept the concenquences...

I've seen it done over here when people park on double yellows and block off buses and other traffic and then cause a half mile tailback in the town...

So if the truck had hit the car on yellows with a person in it having just dropped someone off it would be the trucks fault (because it is OK to stop on yellows )

But because that person is out of the car helping his disabled mother to the shop, suddenly it becomes the parked car owners fault??

If you drive into a parked car, how can you possibly expect to get away with it not being your fault??????? Are you suggesting it's OK to not be in full control of your vehicle and drive into stuff??

dont forget double yellows are a waiting restriction, ya car still legally stop there if ya broken down, unloading passengers or unloading goods too

i respect ya point though but ya cant blame someone who wasnt in the car at the time, he might not have actually parked it there , or it copuld have rolled onto the double yellow

oh and if ya hit a kid on the road whos the big dad gonna blame, his baby or the driver
