To have a go at someone in front is a bit off, even if you are really pissed off about what just happened

Hope everything gets sorted, but your insurance company don't cvome into it, you're claiming on THEIR insurance, not yours

its his fault cos youve always got to leave enough space between the car in front fot that exact reason

Because fault or non-fault you have to inform your insurers asap or they may revoke their indemnity

Yep. Liability will no doubt rest with the defendant in this instnace.

I would hold the defendant negligent in the fact that:

1. He drove too fast in all of the circumstance
2. He failed to heed or act upon the Claimants position on the carriageway
3. Failed to apply his brakes in time or at all
4. Failed to take any or any adequate care for the safety of the claimant

etc etc etc. I have all the proper ones on my comp at work

Phil, yes you will matey. Its your insurance company providing their "Free Legal Expenses"

PMSL, some pen pushing 17 yr old spotty gimp in his burtons trousers thinking he can deal with this. Mate, they are all useless and get laughed out of court.

If you want any advice gimmie a call at work

Sorry about your smash, still a nightmare sorting it out. Happened to me last Nov, still waiting for me money. Put a good claim in for your neck/whip lash, make sure you go to hospital to get checked out, really helps with your claim good luck!

I had this happen to me and I thought you were supposed to inform your insurance company anyway. If you gave him your details they would find out from him if he tried a counter claim as some people do, to try their luck. I just informed mine out of courtesy incase the other guy tried to counter claim but I think he had more sense than to try it!
