Default MOT help

my car is booked in for mot on friday, if it fails, i have been told i have 2 weeks for a free retest. BUT can i still drive it in this time?

im prity sure if the car has 6 mounths mot left ( for arguments sake ) and then if fails an mot the car can then only be driven to and from home to the testing staytion once its issued with a fail then its not road worthy

I had this with a guy before xmas, Could understand if it was bald tyres, no brakes or something.

But I think thats why you can have upto 1 month of existing test added to your new certificate, to stop people waiting til it expires.

Heres a quote taken from another forum I use

No your current Mot remains valid,you could get prosecuted under the construction and use act though if your car is defective, but there again you could get prosecuted a day after a new Mot was issued if the car is faulty!

If you're going to drive your car away from the test station with a VT30 failure, there are some regs. It is illegal to drive a car of MOT-testable age that does not have a current MOT test certificate on public roads, with the exception of driving it away to a place of repair, (which may include your home residence). From there you may be allowed to drive to a pre-booked place of repair, and to a pre-booked MOT test station. So a couple of grey areas there.
Free re-test periods are at the discretion of the testing station, any remaining days on the old MOT still stand regardless of duration.

But some insurance company's state that the car must be in a road worthy condition, if the car fails the MOT but still has say 5 days left on the old one could they not argue that the car was shown to be un-road worthy having failed an MOT test, even though it still has cover for 5 days on the old one?

I'm sure they could, dependent on what they deem to be 'roadworthy'. MOT-wise it would still be roadworthy. Bit of a minefield that may not even be a problem if the car passes!
