the oil level on the dipstick is over the max mark by a fair bit....obviously thats why its burning oil and smoking from the exhaust.....will draining off the excess cure the smoking or could it have caused more damage?

What colour is the smoke? if it is blue that means its burning oil, which usually means the oil rings on pistons are no good.
if its constantly kicking out white smoke (not just after start up) that is probaly the head gasket
