Default Advice on legal implications for cancelling ISP contract....

I signed up to a new ISP as the one i was with could not provide a service that worked with my new computer running Win Xp X64.

After contacting several new ISP companies i decided on my current one purely because they assured me by phone twice and then Email that their service was compatible.

After having signed up to them with a 12 month contract it turned out they were full of S**t.

Not only did it it not work on my new computer, but i spent weeks talking to them, and they would refuse to accept it was their fault, and said the modem they provided was not at fault.

So i took it up with the manufacturer of the modem they supply, having to contact them myself in France and as soon as i told them it was X64 they said
"sorry we cannot support this at this time, there are no drivers for it yet, but we're hoping to have them by december 2005", and went onto to say i'd been misinformed by my ISP.

This has now dragged on for months, ive gone through their compaints procedures right upto manager of Customer services but get no responses at all.

Ive now had to take it up with the umbudsman for telecommunications (otelo) and am waiting to see what happens, but they say i have to wait 6 months for my ISP to try and resolve the issue

Si im thinking screw the ISP, they've been nothing but hassle, never helped me, so where would i stand by just cancelling the contract, as i bet if i did they'd be in contact then....

I was thinking along the lines of 'not providing the service they imformed me would be compatible'.........

Any advice???

First why got to all this hassle when there is a simple cost effective fix for this easy problem. All you need to do is buy another modem that uses an ethernet connection and then there is no need for any drivers.

Is it a bt based telephone line you have?

If so this will work on your system. your isp may even credit the cost to your account.

as above use a router with build in modem that doesnt need drivers.. will just use a cat5 cable and ip, job done

or don't use Win XP 64bit cause its tat and got no driver support

Cheers fella's, but whilst i was already aware that i could go an ethernet route, i dont see why i should have to pay out any more money.

Its their mistake it doesn't work not mine, so why should i pay???

It would be like buying a new car, driving off down the road from the showroom only to have it blow a head gasket....would you pay to get it fixed yourself? i doubt it .

Just because this is a big company they think they can just screw people over and get away with it, and im not happy

If anyone has any advice as to the legal aspects to me cancelling a contract with them and then having them take action as they say i agreed to the contract feel free to advise......

or cancel you direct debit/standing order payments, wait till they contact you, tell them they lied and to go and do one!

They will prob try and chase you for the cost of the remainder of the contract.

Sounds to me like your just being a pedantic fucker though. You may find in your t&c's that they have a clause to cover theyre ass in these sorta situations.

From what your saying there is no fault with the hardware or the service they provide, only that drivers havent been released for the platform your using. Even if they did release them you'd probably have more problems and headaches with early release drivers.

As others have suggested, cough up 60 quid for a proper modem/router combo.

I ask before hand if the company can support win xp X64
they say yes 3 times.

contact them over 20 times and get no answers
then get no responses either from Customer services, Customer services Supervisor and the manager.
Modem manufacturer now says the driver wont be ready until at least the first quarter of 2006.
Customer services is shockingly bad, no resolution to my ongoing problem, no responses.........

So why exactly am i being pedantic in wanting to cancel my contract with such a useless bunch or ar*eholes???

They are the most useless people ive had the misfortune of dealing with.

Why should i have to pay out Ł60 for something they told me i wouldn't need???

The hardware is dependant on the driver for it to work, therefore no driver no hardware.

You're obviously the kind of person who has plenty of money unlike me.

The kind of person who'd walk into a shop buy something only to find the box is in fact empty, then go back into the shop, buy the contents and pay again....

Tony and Andy,

Thanks for the response, ive been looking into getting a router (once ive sold some more car bits) if nothing else to give me better control over the internet access to the 2 computers i have irrespective of the cr*p ISP im with.

although trying to read my way through all the various options for routers etc is pretty hard going when you know as little as i do about networking......

Cosrush, the link I posted has a modem and four port router and its only Ł22+ delivery. Out of interest where did you get your copy of 64bit windows from?

Yeah thanks for that, ive just had a look. Might be the best bet

I got my X64 from a company who advertise in Micromart, cant remember the name off hand sorry, but i'll have a look and see if i can find the receipt, and get back to you.
