Consumer rights? Repair?
Hi,
If I buy something and it's under warranty am I entitled to insist on the item being repairs or replaced rather than a refund?
I bought a dishwasher from Safeway (Small Tabletop one) for £80. The seal round the door has gone. No all they will do is refund me. They won't repair it because some rubbish about they don't have people to do it and they have no stock to replace it.
Comet sell the same product for £149.99. If I get a refund I will have to put in £70 to get the same product working.
Am I legally entitled to insist they pay for repair?

From memory, yes you are. I think you'll need to be very insisitent and polite ..... Its there problem to deal with it. I'll try and dig out a link for you that I used just before christmas when I had a similar problem with the same monkies ....

Jim, Safeways occassionally buy different items than they usaully stock from various sources .... then they try to imply that once you bought it, you inherit the problems if any occur, which is totally wrong.
I came very close to clumping some old git that smelt of piss when he told me this but luckily I beat him with a war of polite words instead as I didnt want to spend christmas in prison
It really pisses me off when some of these big companies try and quote their policies which aren't worth shit IMO .....

Just phone trading standards. Aparantly they are entitled to just offer me my money back. Safeway said they may pay like £20 if I get it fixed but a plumber is going to want £50 to get out of bed.
I called comet and said I'd bought one from them and asked to buy a seal. If I can get it cheap from them I'll get safeway to pay and do it myself. Fooking terrible really but it's that or I pay £70 extra!

If it's still under the manufacturers warranty and the seal busting has occured because you've been using the dishwasher as a dishwasher [rather than a garden ornament] then you are entitled to a replacement dishwasher.
The whole trading standards laws are based around the premise that whatever you buy must be fit for the purpose of what you buy it for. When we sell our cheapy px's, customers have to sign an agreement that they are buying "parts" instead of a car.
When you buy a dishwasher, it should be fit for the purpose of washing dishes and if its withing a "reasonable timeframe" they have to fix it, replace it, or give you your money back.
However, no matter what advice you get, if this went to the small claims court, it's up to the judges discretion as to what a "reasonable timeframe" is.

I think the offer of a refund means Safeway have complied with the consumer laws.
Shops usually get the problem the otherway around. Insisting on repair or replacement over a refund.
I would speak to head office. If you are polite and insistant enough theres bound to be a new unit at a branch somewhere.
