All I had was a nice bruise on my hip and a few pulled muscles, I was only dong about 25mph when I got hit

Made a list so far of what bits it would need:

Nose fairing
both side fairings
clock frame
clocks
forks
headlights
screen
brake lever
right hand handlebar and throttle grip
new can
new rear brake lever
front indicators
mirrors
mirror frame
engine casing

So I got the feeling the insurance are gonna write her off

However you can always buy another one plus claim for leathers , gloves a new helmet , boots etc etc

 

It happened the day before I went on holiday as well, I was glad really I didn't hurt myself otherwise I wouldn't have been able to go, but its sunk in over the week, I was gutted when I took the cover off again today

She's saying its my fault already, that I had the wrong road position (I didn't)

doesn't matter she shouldn't have pulled out of a side road without it being clear

 

There is currently a big deal with riders being found 50% liable even in cases just like this.

Important thing is you're not damaged.

Go all out against her if shes even trying to blame you. And claim for the lot, new leathers, lid, boots, gloves, bike, underwear, emotional distress, fear of cars now. the works.

Play the assault card - she seen me and pulled out right in front of me, like she was TRYING TO KILL ME!!

im not taking the piss with that by the way. If you give an inch the courts will take a mile. seems to be the trend at the moment to villify riders.

To be honest Wes i'm quite sure thats bullshit so don't worry, I mean how the fuck can you be held even 1% liable let alone 50% when you were on the main road and it was down to her to check the road was clear before she pulled out!

I wouldnt think it possible either but i personally know two people who its happened to and i know of a lot more.



So while i agree he shouldnt have any problems theres a chance he may and should be aware of it.

One of the guys i know was done for 50% liable in a similar circumstance, simply because he didnt have his lights on. according to judge he would have been seen (in broad daylight) if he had so it was his faulkt the driver failed to see him.

I would have told the judge that unless its law to have your lights on in daylight on a bike he could go fuck himself and try again with a different excuse

My lights were on by the way lol

The stupid bint didn't even realise I'd smashed her headlight, wing and bumper till I told her to go and check it cos my leg hurts lol, she thought I'd just caught her wing mirror (shows how much attention she was paying to the road)

This is what happened to my colleague on Firday when an old duffer pulled out without looking when he was less then 10m from the jct

 

Guess so mate, I fight things like this at work and personally would try my hardest not to let this happen, but then I know where your coming from!

Whether we like it or not, most things to do with courts/judges etc are not in our favour alot of the time!

 

Last week my mate was riding on a roundabout and this bitch pulls onto the roundabout and sends her off the bike as well

She was on an FZR as well
