its not at all bullshit mate.
I wouldnt think it possible either but i personally know two people who its happened to and i know of a lot more.
So while i agree he shouldnt have any problems theres a chance he may and should be aware of it.
One of the guys i know was done for 50% liable in a similar circumstance, simply because he didnt have his lights on. according to judge he would have been seen (in broad daylight) if he had so it was his faulkt the driver failed to see him.
complete bollocks i know but thats how the legal system is.
