just had a letter from my bank saying i have gone over the overdraught limit, checkd the homebanking and its a bar i was in that i was in on friday, they said i coulnt pay for drinks on my card unless it was over £20, so i left with the drinks still on the bar ( and forgot my card was behind the bar_, turns out they have put it through under 20 quid anyway when i was gone without my authorisation, and hence now taking me over my overdraught limit,
phoned the bar and they say its not their problem as they cant be held responsible for my card left there
any legal info on this appreciated.

best of it is, they cant find the card now either so ive cancelled it, but i remember giving it one of the bar staff, who walked off with it and came back asying they couldnt do it, i walked out forfetting they still had my card.

It's theft plain and simple. Report it to your card company. Did you pay for the drinks by another means and they still took the money on the card or what?

just say you lost your card had no idea where it is and all your money is gone STICK TO THE STORY!!!!!!
aslong as you haven't signed anything your scott free and the bank will return the cash within 48 hrs but only if those words are said!!

no , cos they said i had to spend over 20quid to pay by card i thought stuff it, fookin up its own arse bar anyway. but they have taken it off the card even though its below their card limit policy,
going to the bank tomorrow, apparently there is a for you can fill in so say as of a certain point it was stolen and so all transactions will be voided, but how thery get the money back form the bar i dont know?!?

no mate what happens is the bank give you your money back then the bank tackle the bar to re claim there own money back you see they will sh!t them selves when the bank start d

If the bar cannot prove you bought the items - IE signed slip, pin verified slip or verifiable delivery address then the bank will take the money off them without question.
They dont have a leg to stand on. I doubt if you get any overdrawn charges back though :cry

If it's switch/solo then your fooked. There are no insurances against fraud as with credit cards. They can stop anymore occuring by stopping your account, but you will not get you money back without taking them to court. Signature means nothing, just like ordering online, over phone, etc. Happened to me
