anyone know if i can go to small claims for this?
right,some of you may know that last february some fooker got into my saff on a RAF base and stole the wheels,dumped the car on its discs and a baby seat,then stole my stereo (pioneer and rockford fosgate stuff,NOT cheap!) and speed camera detector,now i reckon that lot adds up to me losing about a grands worth of stuff,the discs which were 175 fronts and whatever std rear ones are,so lot of money for me,so much that it really tipped me into breaking the car as i had a blown motor also at the time the RAF cops found me wheels,ive been to look at em and theyre mine,BUT those of you that ever saw the car will know they were in VERY good condition,and i just had new 215(to stop the rubbing) tyres ALL round,however they are now kerbed to buggery and the tyres will probably need replacing as well! the guy who did it has been to military court and after an appeal of his sentence(7 days in colchester!!!!!!! )he got a 500 pound fine ONLY!! excuse me? so now i have NO stereo and have to shell out nearly 400 quid i would have thought to put the wheels and tyres right again,so basically he has been taught a lesson by the law:steal and you can profit! cos the stuff he sold would have been more than the fine! can i take him to civil small claims court do you reckon?i didnt get the 500 quid,but am left with crap wheels and nothing else! cheers

Its a hard one to answer realy if he has'nt got any money (reason why he nicked your motor ect) then it could be a Big wast of time imo
If you did get him to court he would probly get off with PAY it in instollment or some thing like that NOTE "Crimnals get any with Murder Now days"
And we have to paid for them

just spoke to CAB and i CAN take him to small claims!!!! gonna go through RAF first to try and sort it,but at the end of the day,he is in the RAF so gets paid EVERY month and WILL be able to pay me!right,time to get me some cash!

500 fine,i didnt even know it had gone to court,just got a call saying "you can pick up your wheels now,cheers!" i lost about 1000 to 1200 quid worth of kit and now have to get the wheels refurbed! so i want some cash outta the sod who dunnit!

I used to invoke the Army Act against soldiers who wouldn't pay their loans.
The RAF equivalent is (funnily enough) the Air Force Act.
Go to the Sheriff Court (Small Claims in England) and get judgement. Then send a letter to his CO.
There is a risk to this because military discipline is tough (as you probably know) and he could be dismissed. If he isn't thrown out, the CO can decide how much to dock from his wages and pay to you every week/month.
I've been away from all that for 18 years now but I don't believe it has changed because civil recovery like wage arrestments (attachments in England) can't be used on serving forces, and Sheriff Officers or Baillifs can't get onto the bases to enforce Poindings or warrant sales etc. CAB will keep you right, but unless they are in a big garrison town you m,ight need to point them in the right direction and have them look up the rules and regs.
