Caught speeding urgent help required
#241
Update - I have a specialist motoring solicitor on the case as of Thursday morning. Obviously I'm not coming away smelling of roses but he is confident there is room to manouvere and he can assist me and possibly prevent a ban. Downside is it's going to be costly as I will have the legal bill as well as the fine the court will impose on me.
1st big fuck up in almost 400,000miles of driving. Hopefully be as long again until my next.
Thanks for the advice and support people

Don't take this the wrong way but what can he say other than what happened I can't see any mitigating circs other than the hardship aspect which you could read yourself.

When I got caught (and done) for similar............
Lessons I learnt
Plead guilty at the first opportunity.
A police car accelerating to keep pace and then increasing speed to catch up is plenty enough for a conviction.
Wearing a suit does fuck all.
Having your own solicitor means fuck all.
Now... additionally....I bet my bottom dollar that if you pitch up with mr flash and you lose you will get a worse punishment than you'd expected.
Also..... if you're really going to go for it - ask to go to crown, be convicted by a jury of your peers rather than 3 magistrates who hate boyracers

My thoughts exactly theres no way with the cars he's owned / now owns that he's never excessively broken the speed limit I don't give a fuck what you say about stereotype be honest and be honest with yourself. Good luck to Steve though it's definitely made me think about my speed

Sorry to say if the evidence says you are guilty he could be Perry Mason it will make no difference. Just remember hes after your money he will get that guilty or not guilty. You have been warned.

And I take it you both could do a better job of defending your selves than a solicitor who specialises in this area?
A solicitor isn't going to wave his expensive Italian wand, go back a few weeks and stop you from breaking the law... what he will do though is sift through the amazing amount of waffle and attempt to get you off on a technicality.... He will know far more about necessary details (equipment calibration equipment, type of equipment used etcetc) than most people will be aware of.
Friend went though this not too long ago, 90 in a 30.... didn't stand a chance but the solicitor managed to reduce every thing to a big fine and 11 points. Well worth the money he spent.
So he should do nothing? just have a little cry wank and say sorry for being such a silly boy? I wouldn't.

I'm not expecting a miracle. I am expecting to have my arse kicked. I have simply sought proper representation. Not a case of being Mr Flash or Perry Mason just attempting some damage limitation

I got pulled by a real policeman stood in the street doing 37 in a 30 yesterday. He said don't do it again. I said yes sir, sorry sir, three bags full sir. Then he let me on my way.... I was very lucky and I hope you do okay mate. Have you got any points currently? Hopefully you'll get a large fine/number of points and keep your licence good luck bud

Rob,
Basically his solicitor didnt turn up he represented himself and had it thrown out.
Im not saying I could do it better than a solicitor but in some cases if you know it's damming what's the point saying I'm gonna try to wriggle out using a specialist if not Ill claim hardship even though Ive spanked a load on a defence.

Rob,
If you cant do the time dont do the crime. You guys bending the law are whats wrong with this country im afraid.
I speed, i get caught, i own up. Only 4 times in 50 years but each time caught dead to rights, deserved what i got. Did i learn my lesson NO!!, I still speed but dont try to fudge the issue when i am caught. I would still be in 3rd at 130 & just getting started & he would not have caught me be assured .
#255
if your driving your car registered to you then be assured you will be caught.it might not be on the day you did it but however fast you go its unlikely you can outrun the human eye or camera that can get a glimpse of part of your number plate and a brief description of your car. thats enough for the knock on the door a week later.

Yes he should own up face up to breaking the Law.

I don't want special treatment or attempt to get off on a technicality. Just a fair crack and a fair penalty.
I don't think a defence of "Rods car would have been doing 200" will be of much use. Yes your cars fast, we get it! Why do you feel the need to keep getting it in at every oppertunity? Maybe you can come to court with me and you can tell them how your car is faster than mine and a tiny little 120 is not bad at all?

I absolutely am facing up to doing wrong. Unfortunately magistrates punishments are so inconsistent I can't just hold my hands up and take a wrap on the knuckles. There are countless examples of people getting larger penalties for less serious offences, and others getting very leniant penalties for far worse.
One thing to think off is if you can take a short ban might be better than 9 to 11 points for 4years. I had 9 points for 3years before it went to 6 and it does play heavy on your mind when driving.

Indeed, is it just coincidence that his name also sounds like a part of male anatomy...

[QUOTE=STURS2;5915519]That is wrong. I received a fine higher than that for doing a touch over 100 with no ban.[/QUOTE
Exactly.never heard so much bullshit in all my life than you can only get six months for first time.well why did I get a year with no previous points!

Oranoco - Good luck! Imo, a few grand spent is better than a ban of 3months plus.
Did you manage to find the book i mentioned earlier in the thread, mite be worth a look through.

I got caught speeding years ago by a mobile speed camera.
Over double the limit on a dual carriageway so court appearence like you.
I also had a solicitor represent me after seeking advice - based on the fact of my age and only driving for just under 2 years i would have recieved an instant ban for 6 points and a revoked lisence.
The solicitor put to them i needed the car for work and was in a responsible position whereby i needed to get there ontime every-time etc - I also got a character witness from my manager.
They gave me 5 points and a hefty fine, and i stayed on the road. (Some would say its wrong but i sold the quick car and drove like miss daisy for a long long time - certainly taught me a lesson)
Your best case is plead you need the car for work and that your not a chav moron who does this all the time, they may be lenient with you then - good luck with it, your clearly not an asshole but the law is the law and it will be down to the magistrates on the day....

A friend of mine had an accident at 9.30pm with a parked car that had its wheels turned into the road - no injuries, van was damaged so he left his details of where he was going and home details and went to the party he was on his way too. Police turn up at 11pm at the party my mate (who has no transport now) had been drinking got taken to the station and blew 136 (iirc) on the machine got put in the cells for the night. They said they were going to do a back calc due to drink level etc etc
Basically his solicitor didnt turn up he represented himself and had it thrown out.
