If your insured and booked in for an MOT then you'd be unlucky if they pulled you over and took it further.
Ive been pulled had insurance booked in for MOT and had my documents ready to tax it and they said it was fine!
Also had a mate in the same position and he didnt have insurance either but was booked in at garage.

Technically you're insurance in invalid anyway as they won't insure a vehicle without mot. As long as you can prove you're going for test, you're fine.

I got caught by a dvla camera a few years back, just sent a letter stating where I was going, they could see the car was mot'd the following day and taxed, case dropped. As long as everything ties together you won't have a problem.

how do you know that without seeing his policy?

I know mine is fine with no mot, as long as the vehicle is roadworthy.

As long as you are driving to a pre-booked MOT and you take no detours then you are legal.

I got stopped with no tax on the way to mot and they was going to take the car, The officer let me off as i could get a car trailer to me within 20mins, which he then give me a 20min ear bashing for not using it in the first place.

Yes, but if the car is unroadworthy you can still be prosecuted if stopped and inspected, as you can be if it's unroadworthy and you are on your way to MOT.

from, http://www.direct.gov.uk/en/Motoring...icle/DG_069671

Driving an untaxed vehicle to an MOT test

You can drive your vehicle to and from a pre-arranged test at an MOT test station as long as you have adequate insurance cover.
This also applies to vehicles being driven to and from a pre-arranged test at:
  • a Vehicle Inspection Check (VIC) test station
  • an approved weight testing station and reduced pollution test station

if it was pre booked and you were insured(and they could verify it) there was no way they could take the car for no tax
