Default Selling cars and timewasters

Ok had one of my cars up for sale, got a decent amount of interest but nothing concrete, until a lad from wales came up to scotland to look at it, he agreed to buy the car and left a £500 deposit which i was happy with until he sold his car which was a week past on saturday. Since the car wot not taxed , he agreed it would probably be best if we got it transported to wales, and i agreeded to split the cost of £250.

Totally ran after this lad for 3 weeks arranging everything even put it back into bodyshop to sort out minor scrape on the pillar.

Bankers draft was suppose to arrive saturday for the car and was suppose to be transported thursday this week, it didnt come and i havent been able to get a hold of this lad since, started thinking he was backing out, and how correct was i , the arse has wasted my time for 3 weeks and im absaloutly fuming about this, best of it is now he wants his £500 deposit back or he is going to the police , i told him to go jump for his £500

totally ragingin at the timewasters when selling a car

If hes left a deposit then that money is yours, the idea of a deposit is to pay a small amount up front to hold it for the buyer. Tell him to go jump!!! And the police wont do fuck all.

Totally agree mate! Tell him to feck off ! The minute he backed out he lost the right over the money! at least that will go someway toward compensation for the hassles and the paint shop!!

Totally within your rights to keep the money chap!

Tho, this sort of thing is why I ALWAYS draw up a contract (bassically says deposit left for agreed sale of car blah blah, but the important bit is to add that you keep the deposit if he fucks you about or backs out and both of you sign and you get a copy each - takes no more than 5 mins in MS Word to do) then when someone backs out you both have a signed "reciept" so you can prove you're in the right

I had some guy leave a deposit on a car, £600 car, £200 deposit, after 2 weeks messing me about he showed up with the cash and wanted a test drive, after that he said that he would give me £500, i politely reminded him that £600 was the agreed price and if he wasn't interested he could piss of leaving the deposit behind, he bought it for £600!!!

Best was he thought he could take the car after leaving a deposit and pop back to pay the rest at his leisure

Tricky in your case as it is a bigish deposit so it is likely he will try and get it back and I'm sure by law you have to unless it is written that it is a non refundable deposit.

Doubt the old bill would do anything, from one point of view, he gave you 500 sheets for nothing. You could always say he never gave it to you

doesnt really bother me that i got £500 for nothing, id rather have the 7k in my pocket , the space and the car gone !!

Im gonna tell him to stuff it , just annoyed he has wasted my time and i could ave sold the car to another lad who was interested but came to late, and i dont have any details for him.

I really need the space as i alread have 3 cars and the lass has 2 only 4 space for the cars in the garage

ah well may as well go get pished with the £500

another thing that pisses me off is people ask you something, you reply and they cant be bothered to send a quick pm sayin thanks but not what im after, someone on here has twice now asked me to find something out about things that are not even mine and cant even be bothered to reply.

i took the back seats out of the car for the lad, fitted new door cards, arranged pick up of the car etc, got it in and out of bodyshop , a full valet and also gave it a whopping polish !!

hey buk it sounds like you went out of your way in both time /effort/money to get this car sorted for your would be buyer, i reckon all that lot comes to about £700 ? why not send him the bill ? less the deposit = 200 dobs. cheers nomad

could be a sticky one if he gets a solicitor in coz unless you have a agreement in writing he is entitled to it back.it happened to a mate of mine and he had to pay him back.makes you sick

or he could go to small claims court and file a claim for monies owed which will cost him £10 and you will have to provide representation out of your own pocket! simple procedure to.

always best to draw up receipt stating deposits non refundable.

That's total horseshit.

He needs concrete evidence to say he handed over 500 pound to you personally for a deposit on the car you are selling to him....

If a deposit invoice was handed out yes might be a sticky one..depends what u wrote on the invoice....without a note/invoice...your 500 pounds up for nothing.

If no written receipt was given he has not got a leg to stand on UNLESS he claims the money paid to you was a part-payment and has a witness to the transaction but even then with no document stating it was a part-payment he is on dodgy ground.
I know the above to be fact as I took a motor trader to court and successfully sued him for his attempted non return of a part-payment on a motorhome (I found out it was clocked and the HPI report he supplied was tampered with as well).

I dont know why he backed out to be hoenst, there was nothing wrong with the car at all, and he wouldnt have given me a deposit unless he was happy with it and wanted to buy it !!
