Default Ever been fined by the SORN people?

Just got the shitty letter through demanding money.

Bastards!

But I had an idea;

buy a pile of shit, or get given it(even better)

Register it to

Mrs P Wooley
c/o C.R.C,
Alhambra House
45 Waterloo Street
Glasgow
G26WY

Thats the enforcement manager at the SORN office, and then proceed to run every speed camera about and get parking tickets and clamped, no tax etc

Just leave the fooker and see how she gets on!

B'stards!!

I still wrote them a shitty letter, I'm being fined for December, I didn't get the V5 until January!

I'm sending them two cheques for the back tax and I've told them I expect one to be returned!

I realise that you probably don’t care and that I am wasting my time but I am very annoyed that I have received the penalty notice for the above car. The £40 is fair enough, but the back duty of £27.50 is unfair as I could not tax it before early January also I could not state when the old tax ran out as I did not have the old tax disk.

Your penalty letter states that I was the registered keeper on 01/12/04, fine that’s correct! But I applied for a log book V5 on the 8th of November and did not receive it until two months later in early January! I could therefore not even tax the vehicle for December.

I have enclosed three separate cheques, one for £40 for the penalty, one for £13.75 for the tax due for January 2005 (the earliest that I could have taxed the vehicle) and one for December 2004 which I think you should return. This after all is down to the incompetence of the V5 issuing office, if they had been quicker; I ‘could’ have taxed it earlier.

Now I have tried to SORN other cars without them being in my name only to have the SORN returned. I think you should change this, it’s a stupid policy, your own V5 states that the registered keeper is not the necessarily the owner. I also suggest that a SORN statement is sent with every V5 sent out other wise people will assume SORN is transferable.

I am also aggravated that I call 0870 240 7779 before 17-00 and get an automated response saying you’re shut, surely you should have operators on hand to answer the calls between the hours of 9am and 5pm as stated in your answer phone message.
My letter.

good enough or am I wasting my time??

RE E****CAN

To Whom It May Concern:

Please find enclosed a cheque for the amount which I have been Fined.
I would like to add that I would like you to check and double check your records and see that this car was scrapped and declared on 01/11/2003 at the address on your supplied paper work Before the cheque is banked/cashed.
I would also kindly request that I am supplied with methods which you can provide me in writing to how you prove that this paper work has not been lost in your system.
I know with your new system you provide me with a letter to confirm the status of my vehicle. However the scrapping of E655 CAN was prior to this so it was assumed that the declaration was all ok and I would hear nothing more.

I would like to say that I am not trying to be difficult, I just know that I am an organised person and things like this are dealt with as soon as possible.

If you do need to contact me in person please call

***** ******* or write to the above address.

Yours truly,

Mr Lee S Byatt

I got a letter saying sorry and they dropped the fine.

Before you send your letter, you can check what records they hold on your car. Use the link below and click on the Vehicle Enquiry tab.
Follow the instructions then enter the Reg number and make of your car.

This will show all the latest data they hold on your vehicle (not owner details). It will tell you the date that the last V5 was issued. If this ties up with what you have written in your letter then you'll have a valid argument and prob get your cheque sent back. If you lie to them about when they issued the V5, they will know! lol

Date of Liability 08 11 2004
Date of First Registration 22 10 1990
Date of Last V5 Issue 04 01 2005
Year of Manufacture 1990

Is this good? It shows the V5 was not issued to me until 04 01 05.

I did buy the car on the 6th of November just without a log book so I had to apply.

Ginge, they have recently upgraded all their systems and now a letter is automatically generated to the registered keeper if a vehicle isnt re-licensed (taxed) within 14 days of the Tax running out (this is the theory behind it anyway).

It certainly is the case for all the vehicles we tax at work, you gotta keep well on top of it all now or it's can cost big money!

I got a letter the other day at work for not declaring SORN or transfer of a Truck I sold in November. They charged us £40 (£80 if not paid within 7 days altho it took 4 days for the letter to get to us) and something like £90 back dated duty. The truck had a cherished reg transfer when I dealt with it so I was waiting for the new V5 to come back so I could transfer it to a trader. In the meantime the tax ran out but I didnt know.
Chased DVLA for log book twice, it was finally issued early Jan. Wrote to SORN office in Northampton telling them I couldnt transfer the title of the vehicle cos I was waiting for log book thats why SORN wasnt declared.
They wrote back saying it was still our responsibility to notify them so the original £40 still stood (which was cool cos I thought it'd be the £80 as it'd taken so long to send my letter back to them). But they did waiver the back dated duty charge which I thought was pretty decent of them.

The DVLA are starting to get their act together, their online services are improving each month and they are getting shit hot if you dont stick to the new taxing laws.

It depends what date you told them you took ownership of the car. You are liable for back duty from this date, and if you are saying that you told them you took ownership in November then you will need to pay for back duty for Dec and Jan as you admitted being the registered keeper during this time.

Their argument will be that you are not supposed to buy a car without a log book (or the new keeper section of the log book). If you follow this rule then you have no excuse not to tax the car - This is the way they will look at it so dont shoot the messenger (please).

I've had a SORN fine too! And I did nothing wrong, my car was never on a public road with no tax, it was at a garage and I just didn't declare it SORN. I wrote the Wooley biatch a letter, but she didn't even reply and I still had to pay the fine.

Ahhhhhh this also explains why it took so long for them to issue your new log book!!!!

You cannot apply for a log book in your name anymore without the previous keeper being notified first. You would have requested one, they then send a letter to the previous keeper and give them 14 days to respond. If they dont respond they send a fine to the previous keeper for not notifying them they had sold the vehicle, and then they issue you the new V5. The whole process takes around a month and gives them another excuse to send out fines to lazy people lol

But you DID do something wrong.

You MUST either tax a vehicle or declare SORN. By doing nothing you get fined. The rules changed over a year ago now so they operate zero tolerance to people who say they didnt know. All those leaflets you get with your tax reminder explains it all.

I bought the car from the scrap yard on the 6th, they had taken it in on the 5th. I assume the chain of ownership was a headache having to write to the original owner, then the yard then issue my V5.

I got a receipt but no part of the V5.

I'm up for an argument I prefured the old way!

clare i would belive ya if it wasnt for the fact that i have done it just 3 months ago on me cabrio (tax runs out on end of april ) and just last week with the cossie that ran out on 31st of december, i tested it and so far im right, remember its just a month, no longer and when they send the fines is when its over a month, otherwise its just being picky

bit like yab cant get a ticket untill 4 mins after a meter expires or ya cant get done for speeding usually doing 75 on a motorway

trust me on this, when theres a scam im usually doing it on one way or another

and i dont mention things that i aint alreadu tried meself, i send my "i did sorn it" letter to the scotland address and got away with that to, i never thought i wiould though tbh as i was bang to rights, also they send me a fine for 3 months back dated tax and 40 quid fine , thats why i tested the other fine with the cabrio and iv all ok on that one too

anymore scams ya want help with give me a shout , i can usually get my point across when i type a letter

I just chuck all those leaflets in the bin...perhaps I should've read them!

I didn't really break any laws though, I know people that have driven for years without any tax on their cars, my cars in the garage for a few months and I get a fine!

Also since I re-taxed this vehicle they keep sending me letters saying the car isnt taxed, the first time I replied giving all the evidence they required that my car was taxed. Few weeks later received the same letter again, didn't do anything about it this time, I've now been sent a letter saying I'm under investigation and that I may have to go to court, my reply to them was as follows:

My car is taxed and sitting outside my house right now, if you think it isn't taxed come and see for yourself. On your adverts you claim you can catch tax dodgers from your hi-tech computer system but the truth is you haven't got a clue who has and who hasn't got tax. There's tax on my car and it's not my fault your shoddy computer system doesn't recognise it. I haven't done anything wrong and yet you persist in sending me letters implying I have no tax for my vehicle. It is your problem, not mine, you sort it out, that's what you get paid for (allegedly). If you continue to send me these letters I will be forced to sue you for harassment.

M7 COS, under the old system, yes people did used to get away with it for ages (I myself did!)

If I was you, double check the reg number that is printed on your tax disk, it is possible that the Post Office have mis-typed your number plate, or did you tax it at the same time you put your personal plate on? As that may be a cause of the letters. (also check the reg number they quote on these letters matches the one on your car). You'll be surprised how many typos are made at the DVLA.

Clare: The DVLA are just incompetent, my tax disc is absolutely perfect and as it should be, the private plate was on the car a year or so before all these problems started. I'll let them deal with it now, what can they do? Fine me for not being prepared to help them for the second time! No wonder people get pissed off with the DVLA!

My mate has a VW beetle RSi and the DVLA have no record of it even though they taxed it and took his money at the registration office.

DVLA are useless.

You can't SORN a car in someone elses name even if you have power of aturney(sp) or you don't have it in your name. You have to wait until you have a V5 and even then they don't send you a SORN doc so you are bound to forget!

My car sat untaxed in my garage with no brakes for six months, supposedly SORN'd until I received a nasty letter and a fine. I wrote a very very polite and factually correct letter back to missus thingy and a very short while later I received another letter saying they revoked the fine.
You can't beat short, concise and polite when it comes to authority. If they're gonna respond to anything, that's it.
Give it a go.
Good luck.
