bought a dvd drive for my laptop as in write up it said it would fit, but turns up and it dont, only problem is in his write up hes put,

NB: This drive is cosmetically A1 & as new, but is UNTESTED.

The drive is therefore sold without reserve & is non-returnable.

Do you think im still able to get him to refund me?

when you plum the model number in google it says its for a Presario.

 

As it is not as described, you should be able to send it back - therefore sold non-returnable would apply to being untested, not what it will fit.
