Have you got any previous points on your licence? Will it affect you in anyway if you get any? If not accept you were caught and take the points. I got caught doing 56 in a 30 and got 6 points and 200 quid fine and it didn't affect my insurance.

Not necessarily mate, there are law firms that specialise in this sort of thing. Best thing to do is have a google on it and go and speak to one.

How were you caught? laser, fixed camera, undercover car?

However, family member got off a fixed camera, requested a photo, changed his plates to a different style, a few stickers in the rear screen, removed his rear head rests and they said it was a cloned car. Got no points and a letter to carry around in the car saying his car was the real one.

Rob,

Did something similar myself a few years back, but I got greedy.got away with it twice, said it wasn't us etc as it's a BMW cabrio and their pitch black inside so you couldn't make fuck all out and all was well but on the third occassion they got clever and at 630am a right pair of cunts turned up at my house going through the car etc, real wankers, tried saying it was a stolen car cos he couldn't read the stick on chassis number on the dash, fucking retard, just using scaremongering tactics really.

Unfortunatley some nobend garage we'd had work done in had put a sticker in the window and my imbecile other half had decided to remove it the day before they arrived, but not cleaned the glue off which then tied in with all their evidence, certainly worth a try though as we got away with it twice.

Be careful with plates though as unless their laying around you'll have a record of some description of buying them,we got away with it years ago as we paid cash to someone we knew to alter the plates.

You'd be surprised what the Fraud act covers - it is VERY expansive and covers more of less any deceit you can imagine.

Technically any purposeful deceit used to to either cause someone a loss or to make a gain is fraud. Even something like telling lies on a CV is covered under the fraud act.

Having said that, as you say, I doubt he was charged with fraud. A charge such as perverting the course of justice or perjury would be more likely.

firstly was the nip sent first class?

are all the personal and vehicle details correct on nip and match your v5?

ask them for pics but leave it till the bare end of the 28 day return and send letter back recorded....see if you can drag out for 6 months at which point the offence will have timed out.

if picture isnt clear explain you cant be sure who was driving...etc.

there is a site called pipeeo or something like that that can help.

Depends how much you want to spend, you could use the secret four letters, or you could hire a barrister and elect CROWN COURT as I did when charged with dangerous driving, head on at a ploice car with a combined 150+ mph speed, there was VIDEO evidence from a safety camera van, in totall 13 police witnesses, the other car was a police training car doing 100+.
In short I denied the offence and entered "no plea", I walked out of court NOT GUILTY after around 10 minutes, jury and wintnesses were not even called, into the court.
I would do some searches on previous cases of id of the offender which is why I walked, I even claimed my Ł135 travelling costs of seeing solicitors, barrister, attedn court etc.
I still have all the papers from the case as well for any doubters.

Jeez, anyone would think that the OP mowed down a bus stop full of people!! What's with all this talk of high flying barristers, disguising your car and the 'secret letter'???? It's 36 in a 30 for god's sake!

Pay the Ł60, take the 3 points, and next time you see a huge neon yellow box on the side of the road slow down a bit!!

On the other hand, getting prosecuted and punished for somehting that is a non-offence, is a bit ridiculous.

Just because laws etc are in place, doesnt make them right. Especially with most ridiculous speeding laws, that are mostly created to bring in fines.

A hell of a lot of people giving out duff information in this thread!

Listen at your peril.

The person who changed the appearence of their car to claim it wasn't him will of been prosecuted for Perverting he Course of Justice.

Another trick is to get someone to take the points for you they would have to be a good pal and usually someone who has got a driving licence but does not have a car

students are normally a good choice as they aint got a pot to piss in and need all the cash they can get hold of to help with college fees

Believe me I am the first person in the queue when it comes to pointing out the ridiculousness of speed cameras.

I did a huge amount of research when on Redline, including requesting hundreds of documents under the freedom of information act etc.

I discovered such gems at the fact that in Avon & Somerset 96% of ALL injury accidents occurred within the posted speed limit, and of that 4% some of those were drunk/drugged/disqual/ drivers or stolen cars - It proved that speed cameras can do NOTHING to combat virtually all injury accidents.

I also analysed the data and pestered the shit out of various camera partnerships demanding answers to why the injury/death rate was either going up, or not going down.

BUT - when you get busted for 36 in a 30 because you didn't have your eyes open, it really is not worth fighting. The penalties for perverting the course of justice are WAY more than Ł60 and 3 points.

Sometimes it's worth fighting, sometimes it's not.

I got caught doing 36 in a 30. I had a clean licence and had only been driving 2 months. Didn't get the option of a course. Just 3 points, Ł60 fine.
Girlfriends best mate got caught doing 45 in a 30. Got the option of a course, no points, no fine.
Another female freind of mine got caught doing 58 in a 30 (!!!) and got the choice to do the course and no points, no fine! Her excuse for speeding? She was lost and panicked!
Takes the piss.

It depends on where you get caught, and how fast you were going. Some areas don't have the facility to offer the speed awareness courses.

I was caught in Leicester and they were both caught in Hereford, where I live. Just seemed to me, as I was 18 in an XR2i (RS Turbo replica) they thought, young lad, hot hatch, lets shaft him, where as when they had a 5'10 size 6 model doing twice the speed limit playing dumb they let her off.
BTW I'm very anti-police so I'm not the best person to ask
