I take it you've been sent something that looks like a parking penalty charge?
It's not, it's an invoice.
Ignore it.
You'll then get something that looks like a Solicitors letter.
They are but not part of the the law firm.
Ignore that.
You'll then get one from Bailiffs, ignore that.

There ALL the same company and cannot legally enforce this invoice. They can however summons you to a small claims court BUT only for the original penalty charge and not the add on fees they claim you now owe.

End result is there just total jokers hoping people will just pay up and be on there way. I've often thought about opening a company like this hoping people will just give me money

It's a newer version to the Nigerian scam

Yeh i have been sent one Nath, and in all fairness, it is correct that i was in the carpark longer than permitted, but it is a bloody dear fine, and, i have seen reports all over the 'net that they have no right to enforce any fines they issue, so basically was just looking for peoples experiences.

hang on, i'll find the link that tells you to bin all their letters

or at least file thm somewhere you can find them, they were chasing meup the other week for a "fine" they couldn't get paid way back in 2007

I've had first hand experience with them. Not heard anything since. I kept all the letters. In fact, I played a game of hangman on the back of the last one as I kept throwing it back in the letter box. I don't know why but I had it back 11 times. Should of chose a shorter word in hindsight...

Lots of places use companies like this, McDonalds, BK, etc, etc. They do it to free up parking spaces quicker and to deter all day parkers but there not exactly consumer friendly IMO.

No contract. Refused for Cause. Without dishonour. Without recourse.

it's a parking charge notice

not a penalty charge notice

and it's on private property

so they need to go to court first before they can get the court to appoint baillifs to come around and ask for money

I used this company to keep myself a parking space. Due to work on the building our parking spaces moved to a building oposite. I gave someone a parking ticket (Self issued, without commision) and got a phone call a few days later from UKPC. They asked if we owned the parking spaces and I explained we have been given them till building work is completed on our building. I got told to prove the parking spaces were allocated to us or stop issuing tickets.

I never bothered with them again, but have 2 brand new signs to deter people from parking where I want to They sent me a new "Contract" or something the other day I had to sign and send back to them. Threw it in the bin

Their notice/letters is essentially an offer to service an order under contract. You are saying that

a) there is no contract
b) you refuse the offer/order
c) you do without dishonour because you are not lying or doing anything wrong
d) 'without recourse' means that you are not allowing them the right to take you to court for you non-performance under the (non-existent) contract, from what i understand

In any case, it works. BUT must be done within 3 days.

Basically long and short is, they can't enforce jack shit and can only claim from a court the original parking charge and no penalty fines so it will cost them big bucks to get you to court and send bailiffs which cannot do nothing anyway for a few quid. Jokers. But the majority of people are scared so cough up straight away.

if you write back to them,the only thing you should be doing is putting "not known at this address"

anything other than that will just give them the excuse to send more and more letters to you

they can't enforce shit because they say that by entering the location you have read and agreed to their rules and regulations in regards to "parking"

now, if you had been clamped or had the car towed away, you'd be onto a whole different ball park

Dojj - saying 'not known at this address' is a misrepresentation / LIE unless you say it in the right way, and even doing that opens up a massive can of worms. Refusal For Cause is the simplest and most effective way of declining to get involved in private contracts such as NIPs and Parking Notices.

I got letters from a company the same as that as I parked too long in a mcdonalds car park. I just ignored them, I had a couple of letters from their 'solicitors' too threatening me with legal action. Just ignore them all and they will give up!

i've got one of these to deal with too. i'll be writing a letter asking for the picture and then a 'fuck off' letter when it arrives.

Asking for the photo is acknowledging their process - don't do it!!! REFUSE FOR CAUSE - THERE IS NO CONTRACT!!! You cannot be taken to have agreed to a contract by tacit consent if you have been given no opportunity to decline. Therefore there is no consent. There is no contract.

Not contacting them when they have sent their claim is giving your tacit (silent) consent, though. So no, don't ignore them, although that could work if they jsut give up, refuse for cause and they've been told in legal speak to BOG OFF lol
