I had a solicitor to deal with and in court I had a barrister. I think she done a very good job.

If I appeal it will be in crown court and my ban will properly be over.

I'll try and do the course to get a third knocked off.


I now have time to sell all my years worth of car parts and sort all the little jobs out in the house.

I drive for a living ,but at least my company are getting people to drive me around. most companies would not do this in the current climate.

I feel really sorry for you mate keep at it don't let them win,

Ps. i really hope i don't know the witness, (due to my location) if you go to an over night car show you don't expect to sleep unless you drink too much and pass out, thats how i get sleep at USC lol.

just out of interest as i dont think u have said yet, where were u when the car was actually being driven, as said if u were in the pub surely the bar staff would be able to verify u were there till whatever time?!

even if 2 witnesses is enough if they cant agree what u were wearing that night any good solicitor should beable to get their statements thrown out, and if u wernt in the car how the fuck can they give a positive ID, specially seeing as they cant even argree on what u were wearing?!

Im waiting for timrud to post on this one but im pretty sure that
1- a person can't be arrested for drink driving or drunk in charge unless they are "found in the vehicle with the keys" by a police officer
2- if a person claims they were not breaking the law and witness statements do not provide an accurate and matching description then reasonable doubt has to be applied due to no evidence.



Otherwise it means my cunt of a pikey neighbour could phone the rozzers right now and tell them i have just driven my car, they could just turn up round here and nick me .

In fact - irrc when one of Tiffs neighbours reveresed into one of his cars and was pissed by the time plod turned up thats what they said as she wasn't in the car etc.

What you really meant to say is that you were at a show in a feild got a bit pissed seen ppl doing donuts ect thought i will have a shot of that done a few seen security dumped your car! turned up like a fool looking confused saying how did my car get here then coming away with a whole load of pish that it wasnt you when the whole camp site saw you

There is definately more to this story. If it were me and i was genuinly not the driver i would not let it lie. Obviously the other guys doing the donuts know who was driving your car, not much of a car club if they keep quiet about this kind of shinanigans, Thank F@#k I dont have a BMW.

A drink driver pulled into the garage i work in last night, the fella who was on rang the police as he had damaged the car and then parked up.

Police come round saying he had no insurance so they arrested him. They now want the worker to make a statment saying he seen the lad driving the car. Without that the cps will laugh.

Story does sound suspicious.

Leaving your car keys in a tent? Fuckin stupid tbh.

Smelt less shit than when the drain got blocked.

1. Yes you can. You don't need to be in possession of the vehicle keys or actually in the vehicle to be arrested for a drink drive related offence.

2. Depends on what is said in the witness statement and how big the discrepancy is. The evidence won't get totally thrown out unless it's proved to be an out and out lie.

And yes, your neighbour could ring the police and report you for drink drive, although in practice there needs to be a belief that you've actually been drinking (i.e corroboration of the offence) So the officers are likely to ask you for a breath sample first before applying the bracelets.

bollocks , there has to be proof that you were in charge of the vehicle whilst intoxicated FACT

unless the stories of witnesses match and if thier statements are the only "proof" of a wrong doing then its inadmissable as evidence and a decent solicitor would have the case thrown out before it begins , hence people getting away with murder etc

No my neighbor could not ring the police and have me arrested for drink driving as the police have not witnessed me actually driving or exiting the vehicle. this again i know for a FACT as my gyppo cunt of a neighbor did it whilst we were having a bbq a couple of years ago, and as the traffic officer told me at the time if i deny it, its my word against hers.

I know someone who a few years ago drove home from the pub pissed up.

Someone reported him to the police but by the time they got to his house he was already at home with the car parked up.

The car was still warm he was drunk and the only one in the house, car keys were in the kitchen.. this was enough evidence for them to charge him with dd and he was banned for 18 months.

So they can and do ban people like this ..

Exactly.

I'm sure there would be lots of eye witnesses at the pub aswell.. your friends, bar stuff, pub landlord etc.

Why didn't you call the police when you saw your car on the way back from the pub? Did the person leave the keys in the car or put them back in the tent?

The police could of checked for finger prints on both the car and keys.

Mate of mines brother has got away with drink driving twice, by getting home after a minor bump and puring a glass of whisky to apparently calm his nerves.

as previously said the "i was not driving" story don't add up and on e30 zone others all ready stated they see you near car and then go change clothes after security turned up.
even so though it is a bit harsh getting banned and no one likes a grass.

so the only way they could convict you on DD charge is a positive id of you being the driver which they got from the e30 member and security guards.
seemed other members also done exactly the same but never got caught as the security guards never seen them.

should have come clean at the start then just maybe you would not be in this mess
