Default ebay problem

i have a problem on ebay. I paid for a ACT gauge for my S2, and item hasn't arrived yet, 2 months ago. Seller says that may item lost in post office. and offer refund or new item. Today is the last day i can update the paypal dispute to a claim! I mail him to sent new item but he hasn't answer yet. !
So what should i do to not lose my money?
thanks for your answers!

claim mate straight away!!! even if he does send one in the post at least u have a claim in place and you can cancel the dispute if one does turn up!!

In 2 months he should have either given a refund or replacement so dont delay!

Recorded is a waste of time tbh (as a seller) if selling regular anyway.

You are insured for the same amount with standard 1st class (with proof of postage) so i send out std 1st, if goes missing send replacement recorded, saves alot of money over the year.

Special,courior is safest way
