Default Law on rear wiper help

My friend got stoped by the police on a routine check. They gave him a 30pound fine for his rear wiper not working . He needs to get it fixed an stamped by a mot station. I thought that a rear wiper had nothing to do with a mot?

if the arm is still there then its an offence, but if it doesnt work then you just take it off for the mot and it will pass as its not their to fail

I'd athought you'd get an advisory at the most, maybe if the blade was proper hanging etc. But it mite be one of those things, "if its there it must be working".

Its not a legal requirement for any car to have a rear wash wipe , its not part of the mot test and never has been . Lighting is a completely different matter .

Its utter madness that rear wash wipe is an irrelevant check for an mot, last two times i took my car they didn't even check it! but then a fed can pull you up and fine you for it, how wrong. and police wonder why the public dont flaming like them!

Any chance of finding which part of the RTA (Road traffic Act) he fell foul of?
Should be quoted on the penalty eg RTA xyz
