I don't think there's any law to that effect? It's just common practise. Either way, refusing to give one is as-bad as giving a poor one.

That's why I mainly did contract work, could pick and choose then, shortest was 2 days, longest was supposed to be 3 months but got bored so left as was still there 2 years later, but they've now gone bust.

Make one up. Just put down your good friend as a previous employer and say the company no longer exists but you have his home address, and hey presto!

Worked for me........

They never check anyway, my CV is load of bollocks....

Of course you can give a bad reference. The whole point in a reference is so that the new employer gets an honest idea of the candidate in question, its a waste of time if every reference anyone gets says they are fantastic when in reality they were actually piss poor at their job.

That may well be true but proving they are lying is hard. Your word versus thiers.

Plus most employers wont take the chance so you wont get the job.

You cant give a poor reference if it is likely to prevent that person from getting work afaik. Therefore you refuse to give one. Which has always been odd to me as refusal raises more questions.

What kind of reference do you expect from somewhere that sacked you?

just be honest that you left on bad terms that you regret in reflection

ive left a few places on bad clouds in my time (once asked to leave before he calls the police) and so told the truth and got the job, just cause i was honest and never lied about it

NEVER bad mouth a old employer either, difference of opinion is a good way to mention theres no good reference

i got mates who get sacked for all sorts, one of em is a warehouse bod whos always on the theif and he get jobs all the time,, in yet more warehouses pmsl

also there was a bloke who worked at my place who was sacked for stealing, he got a job with a supplier who they delivered too even though they was TOLD why he was sacked too,,, how is that for strange

depends on the job tbh, some people struggle to fill a job and so will take gambles even if its short term

you cant actually d this without fear of legal retaliation.
Its why companies usually only confirm name, position, time with company and possibly salary.

Anything outside of that would be by "word of mouth"

this job i got now i never got a reference ive discovered,,, though i was asked to work for them AND my last place still offer me my old job back when ever they see me and gave me a free rad for my impreza,,,, yet they never took the time to write back to my current employer as a reference

A chap at my old place got the sack for stealing on several occassion and being late, not turning up etc etc.

Anyhow, after a couple of months he comes in and pleads with the manager to give him a good reference, "i'm loosing my house, kids are starving blah blah blah"

So he does, writes him a really positive reference.

Next think the firm is hit with a lawsuit for unfair dismisal lol!!

I remember the owner being MIGHTY pissed as whenever they said he was late, a thief etc, out would come the reference, cost the firm 10k with the legal costs etc.

Manager was very lucky to keep his job.

You are not allowed to give a bad reference, we have had many people sacked for various types of fraud and theft (working with money gets some people that way) the ones that are cheeky enough to ask for a reference simply have their name, salary and time worked with us confirmed and the rest is simply "no comment", this raises enough questions for them to not get the job (usually) if you gave a bad reference you could be sued for defamation of character, even if its all true.

If this is true its yet another case of world gone mad and people being scared to do things that are genuinely correct for fear of legal retaliation

It's true. What most employers if asked will do is say "X worked with us from Day E to day F" Some may even add "His work quality was up to the required standard" if you were sacked for something unrelated.

It cuts both ways though. If you were an employer and you screwed a former employee's chances of EVER getting work. Do you think they will actually move on with their life? And some people change remember. Or what they did was a one off. Better to be neutral and let them be someone else problem.
