If you take car for an mot if it has say 3 months mot left,and it fails does mean that the current mot is invalid

Dont think it does, but why would u take it for an mot 3 months before it was due?!

Most garages will do a pre mot inspection for you which highlights areas you need to sort out before ur actualy mot for a bit of money!

Pre mot it is then a trip to my local freindly garage it is then

im pretty sure that if you take the car for an mot a few months before and it fails then you have the 10 days to fix it if you want a partial retest but your old mot should still be valid until it runs out!

you can take it I think 28 days before it runs out and if it passes the days left on you motor cert get added to the year on your new one..but if it fails your still tested till you old one runs out

i was told that, as soon as it goes into the computer, it's going to pass/fail

the guy i used to go to would do the test, get everythig done, then, if it falied, would let me know to get it fixed

i still had to pay for it but it was a way to get a 13 month long mot

Sorry but that is the biggest load of crap I've ever heard.
It does not invalidate any pre existing mot whatsoever, you can still continue to drive on the old one, this is why you can get 13 months mot, as it is a lot easier to stick it in 1 month early, if it fails on something you can still drive it till fixed and re mot'd.
If it invalidated the old one, you would never be able to get more than 12 months, but you can as above.
I had a car which should have failed miserably(just bought) reported it to Jean Paul at MOT inspectorate, boss of East Anglia, he agreed it should have failed on 11 different points, I was allowed to and did drive the 12 months on the existing MOT, in which time the faults were fixed all minor.

i asked the garage this when i took my old pickup in and it failed on corrosion witin the pescribed distance from a seatbelt mounting (mk5 transit door steps). the MOT tester said it was a grey area now, on the old system it want a problem but since its gone computerised its logged into the computer it has failed. therefore, when the police do a PNC (??) check it will come back as No MOT.
i drove it home (as you are allowed to do) and welded it up, booked it back in, and carried on driving it on the old MOT until the garage had time to retest it, rightly or wrongly i dont know. but you could obviously see the work had been done.
I would say drive it if the work has been done.

but dont hold me responsible if im wrong and you end up getting screwed for it

i thought, if the car has a full, proper mot early, and fails, then it over writes the old mot, so you have ten days to fix it before having to have a full retest !?

if it fails, and you repair it and return it to the garage in under 10 days, they can do a partial retest, generally speaking this is FOC.
over 10 days and it is another full test.
nothing to do with the legality of driving it.

Best you get your facts right first before saying i'm talking crap. I needed to know this for a customer of mine so i spoke to vosa DIRECTLY and that was the outcome. When you take your car in up to 28 days before the old mot expires, the new mot is dated on that day but expires a year on when the old one expires. COCK

If you take your car in for a mot and it still has even 10 months mot left and it fails, it invalidates the old cert.

if it fails and you continue to drive then you have contraveined contructions and use act, knowingly driving a vehicle in an unsafe condition.

if it fails you have no mot simple as.

Mots are technically last for a max of 12 months,as said you can go up too 28 days in advance to keep you original exp date as long as it passes,or gets fixed in time for a partial re-test.

But the MOT is still really only valid for 12 months i just dont know how to put it into words lol!

i think this is now correct, since it went computorised.

I'm not gonna doubt what you are saying bud BUT

I think VOSA need to issue a statement with the correct view on this because i've phoned them up numerous times regarding this matter and depending who I talk to depends on the answer! Some say it invalidates the old one others say it don't!

If VOSA can't give the same consistent answer ...

Twice I've asked my local garage who do my MOTs...well local Just MOTs....who said if it failed I could still drive it til the current MOT certificate expired.

i was told that the electronic mot means that they know as soon as it's gone for one if it's passed or not and that information will be on the machine

so if you get it tested one month and it passes, if you then take it the next month and it fails, you won't have a valid mot certificate on record, even if you provide one bceause the police will say "it's failed, proove that it's passed after it's failed
