Default legal advice?

i have just done a credit check on myself and a judgemnt has come back from the DVLA as unpaid and outstanding! after contacting them it turns out it was a car i owned in 2003 which was a 300 205 gti! it basically was scrap and thats what i did with it. This was oddly not long after i had taxed/mot the car after a failed engine trasnplant and the loss of our unit i just got rid.

At the same time we moved house setup mail redirect and then now i have this where the ovb sent the letter out to tax the car which i never got, the redirect either didn't work or it was after the 6 months period. So as of last week this is the first time i have heard of it. DVLA don;t care and just want it paying which yes ok £100 isnt going to kill me just think its wrong as i had no idea all this was going on.

Or i can apply to have the judgment set asside, great i thought lets do that. Now to apply for that costs £75! and ovb no gaurantee i would get anywhere with it.

Now the problem i have the woman on the phone said even if i pay the £100 to the DVLA this judgment stays on my record for 6 years! i cant get credit for anything now and even if i settle i still cant. Pay the 75 take it to court loose and still end up paying 100 on top.

Anyone come accross a similar situation? i know its partially my fault for not notyfying them but this was 2003 and the letter she said went out in 2006!? i have had 4 cars in between then lol judgment was only filed in 2007 also so why 4 years on :S

You could try going to your local magistrates court and asking for their advice and I would advise that you ask if you can take what is called a statutory declaration, which means you go before the magistrates or district judge and swear on oath or afirmation that you new nothing of what was going on untill it got to the situation your now face'd with.

if you paid it it would still be on your credit file but would have satisfied under it which i dont think will effect you too much

they sent me a letter saying that i hadn't sorn'd a car

i told them it was their mistake as i sent the paperwork off

they sent me a bill for £40

i sent it back telling them to proove that it was my fault, recorded delivery

they didn't write back

then they wrote back 18 months later saying the same thing, but this time the fine was £80

i wrote back saying the same thing

again, recorded

nothing backs o far and this was a fwe years ago

whilie had the same problem as he sorn'd a car i bought off him and i sent the bit of paper off telling them i'd scraped it but they still wanted to fine him

what year did all that crap about having to tell them its scrapped come in? i have paid the fine now its just one thing after another this country. British gas are also trying it on at the min charging me for some warranty work which no doubt they will also win...

Maybe Royal Mail should use thier new profits to investigate the postman that delivers to DVLA in Swansea as hes obviously keeping all thier post in his house whenever he comes on duty

Either that or DVLA are corrupt by policy, and do it deliberately in the hope it raises more revenue.

i agree^

oh it gets better, today i recived the letter from the DVLA saying thanks for payment. Now forward this letter along with £15 to the court to get the payment marked as settled! can they just request what ever they want from us these days!

I 4kn hate the DVLA and all the bollocks that goes with it.If I have to send them anything I don't even put a stamp on the letter.It still seems to get there,I am just recouping my moneys sent to them very slowly.
