Default where do i stand

i bought a 2wd diff off ebay monday night.

when i recieved it today i knew even before i got it out the box it was f*cked because i couldn't turn the prop flange. i sent the bloke an email through ebay today telling him that its knackered and all the planetry gears are smashed and that i would like my money back. i asked him a question if the diff was ok and did it have any play in shaft etc and he said it was all fine (when i checked it there is play in the shaft flanges and i would say the bearings are f*cked). now i know in the desciption he says he does not know the condition of it but i find this very hard to believe as its that knackered even my blonde missus said "thats not meant to jam up like that is it" but also in the desciption he says its in perfect working order which it is plainly not. i looked through his feedback and he has bought nothing for 6 months yet the grease on the shaft flanges is still wet like it has not been off a car long . surely if he bought it 6months ago that grease would of dried up by now?
what chance of getting my money back have i got? i still have the email where he told me there is no play in the shafts so would that be enough to claim my money back as it is not as described?
any help is much apprieciated

Just start a dispute, Ebay always sides with the buyer anyway, so you'll be OK in my opinion.

mate in the listing it clearly says unknown condition
if you want you could ask him to refund you as your not happy with this item

ebay won't let me start a dispute till 10days have passed and they recommend that we try and sort it out between ourselves first if he didnt live so far away i would

if you paid thru paypal you can go into the resolution centre link on the left hand side in the "my e-bay" window. this takes you to paypal. log in then it will have questions like "item not as described" etc... fill in the forms and they will get your money back. if you paid by postal order or cheque then you have to contact e-bay and they will try and resolve it for you. i've had probs like this in the past and to date they have got me my money back. can't understand why people describe goods as as new or good condition etc.. when its a pile of crap when you get it. hope this helps

i only emailed him about hour ago so i am waiting for his reply. hopefuly he will just say yes have your money back, but i can't see it being done that easily

yes thats why it wasn't mentioned in the description
no one would have bought it spares/repair only

i bought three baby items before xmas and they never turned up , opened a dispute etc then had to escalate it to a claim an then got an email today that Paypal had gone in my favour and that id get a refund . weather the seller has the required funds tho is another question

There's a major difference between being able to show you have been ripped off and actually getting a REFUND, might be an idea to get someone who recons these things to give you his opinion as another tactic to try.

paypal will only refund if you send item back then you could end up with nothing+only if he has money in his account

ive got 2 siting there and they usually go for £100,that was dear mate

i ended up paying £190
i have just opened a dispute. i have beeen speaking to the seller and he says tough shit. he says he hasnt looked at it for over a year, so how did he check that the bearings were fine when i asked him? to which he replied they are fine no play at all

£190 is alot for a 2nd hand diff - if you get a refund try one of the trusted traders on here

i have been trying to get one since xmas day when it blew and i've only been offered ones for around £400 and the breakers wanted £250 +postage so it didnt seem to bad. i did put a post up in the wanted section but only had people offer me quaife diffs for silly money and just being after xmas i'm a bit short on cash at the min.
as for money in his account
one of my mates sold a seperate stack hifi on ebay and part of it was damaged in transport apparently. paypal then took the money straight out of his account without there being enough money in the account and put him overdrawn

as said above all the traders want 250+ p+p so it didnt seem to bad as i've been looking for one for 3 weeks now and had no luck

Not being funny but why didnt you contact one of the traders on here as im 100% you would have got a perfect working order diff for not a lot more than that .

I see these posts time and time again on here and yet people still would rather buy from ebay and take a risk that pay a few quid more and buy from a propper trader
