Default the law and stuff

http://news.bbc.co.uk/1/hi/england/m...de/7804056.stm

so stevo gerrad has been charged with boshing some fella with some other lads

do you think he's guilty of innocent?

caught you out there, he's supposed to be presumed innocent until prooven guilty and how differently it's been portrayed in the media instead of just a punch up after hours?

next thing you know he'll be off to dubai having sex on the beach and then complaining about it when he comes back

fightings fighting, so being famous should have no bearing on the case what so ever

what do you think?

if its common assualt he might not even have to go to court. i got an offer to avoid court and no charge on my record if i paid £150 compo to a cyclist i smashed.
if he done it he done it. who knows exept those that were there.

they dont ask what you earn or anything about you. you get a letter through the post and thats it, accept it and pay or take your day in court. it isnt means tested, you dont pay more because you earn more.theres only 1 law in the uk so itll be the same for him.

in his position id pay the offer if it was given to avoid all the press coverage and possible a higher fine and court fees if he lost. doesnt matter if your innocent or not, its less hassle. in my case i still say it was self defence but i couldnt afford to lose possibly several days wages going to court just to possibly lose anyway and if you fight it and lose it does go on your criminal record.

thats steep for a first offence, affrays basically a breach of the peace, causing fear etc.
i got no fine just a £150 compo order and no criminal conviction for assault and thats not my first offence by a long way and i was only in the cells for about 20 minutes before getting a lift back to work from the police.

also people are saying "innocent until proven guilty" well, errrm, he's actually been charged WITH Assault, not on "suspicion of"....that's pretty much as convicted as a man can get........

unlucky

Did you piss off the judge or something?? did you wear kappa tracksuit or a proper suit to court?? I sometimes think youd be better off wearing burberry as the judges always seem to go soft on repeat offending CHAVs and punish those who make an effort to seem sorry after a first offence.

you think you can get decent working guns as a scouser?? more likely a re-activated deact or a drilled out blankfirer thats more likely to blow your hand off scousers arent exactly renowned for high quality control In reality a scouser will just nick your wheels or strip your car

No stereo types here its all based on fact

Just like people later found innocent of murder in court were likely charged with murder

Got any links to show the legal difference of being charged "with" and charged of "suspicion of". I wasnt aware such a difference existed.

its not the polices job to decide if anyones innocent or guilty but to collate the facts for a judge and jury or the procurator fiscal to decide so "with" and "suspicion on" will make no difference.

Thats my point fuzzy. why would there exist such a distinction when charging someone if legally it means nothing

I was under the impression you are charged or not and theres no specific wording with different meanings.

If he wasn't nailed on guilty they would not of charged him straight away. He must be on CCTV. They have chargd 3 of them and bailed the other 3 pending enquiries.

He won't be getting cautioned as they have already given him a court date.

This will be interesting. However Section 3 of the Public Order Act is quite broad, really he could of done anything. Don't see him going to jail. My gut instinct is that the reason they have chraged Affray is because 3 (or more) of them acted together, rather than bad violence and nasty injuries (in relative terms that is)
